Դատախազը կրկին Մերի Մարգարյանի գործն ուղարկել է դատարան

Մերի Մարգարյանի եւ նորածնի մահվան գործով դատախազը արդեն երկրորդ անգամ գործն ուղարկել է Շենգավիթ վարչական շրջանի ընդհանուր իրավասության դատարան: Այս մասինNEWS.am-ը տեղեկացավ Դատական տեղեկատվական համակարգից:
Մայիսի 16-ին դատարան ուղարկված գործը դեռեւս վարույթ չի ընդունվել: Մայիսի 30-ին գործով դատավոր Դավիթ Բալայանը գործը հետ էր ուղարկել մեղադրող կողմին, քանի որ առկա էին թերություններ: Սահմանված եռօրյա ժամկետում դատախազն ուղարկել էր նյութերը դատարան, սակայն հունիսի 6-ին դատարանը կրկին հետ էր ուղարկել գործը: Ըստ դատավորի՝ գործով դատախազը չի կատարել մայիսի 30-ին կայացրած որոշման պահանջը:
Հունիսի 10-ին դատարան ուղարկված գործը` դեռեւս հայտնի չէ վարույթ կընդունվի, թե նորից հետ կուղարկվի դատախազին:
Ըստ մեղադրական եզրակացության՝ «Շենգավիթ» ԲԿ-ի մանկաբարձ-գինեկոլոգ Շուշանիկ Բախշյանը 2015թ. փետրվարի 11-ից հաշվառման է վերցրել եւ վարել Մերի Վաղինակի Մարգարյանի հղիությունը: Բախշյանը, պարտավոր լինելով Մերի Մարգարյանին ցուցաբերել անհետաձգելի, առաջին բժշկական օգնություն` անկախ այդ օգնության դիմաց վարձատրությունը երաշխավորող հիմքերի եւ այլ հանգամանքների առկայությունից, ինչպես նաեւ ապահովել ցուցաբերվող բժշկական օգնության եւ սպասարկման քանակական եւ որակական բնութագրիչների համապատասխանությունը սահմանված չափանիշներին, իր մասնագիտական պարտականությունների նկատմամբ անփույթ եւ անբարեխիղճ վերաբերմունքի հետեւանքով դրանք իրականացրել է ոչ պատշաճ, ինչն անզգուշությամբ առաջացրել է Մերի Մարգարյանի, այնուհետեւ` նորածնի մահը:
Նույն բժշկական կենտրոնի բժշկուհի Անի Բաբելյանը 2015թ. հուլիսի 25-ին բժշկական օգնությունը եւ սպասարկումը կազմակերպելու ժամանակ, իր մասնագիտական պարտականությունների նկատմամբ անփույթ եւ անբարեխիղճ վերաբերմունքի հետեւանքով դրանք իրականացրել է ոչ պատշաճ, որն անզգուշությամբ առաջացրել է Մերի Մարգարյանի, այնուհետեւ` նորածնի մահը:
Բախշյանին եւ Բաբելյանին մեղադրանք է առաջադրվել Քրեական օրենսգրքի 130-րդ հոդվածի 2-րդ մասով: Բախշյանը գրավի դիմաց ազատ է արձակվել, իսկ Բաբելյանին նկատմամբ խափանման միջոց է ընտրվել ստորագրություն չհեռանալու մասին:
