Գերմանիայի ՍԴ-ում Ցեղասպանության բանաձևի վերաբերյալ հայցը հեռանկար չունի. փորձագետ

Հայոց ցեղասպանության ճանաչման բանաձևը չեղյալ համարելու հայցը Գերմանիայի Սահմանադրական դատարան ներկայցնելը դատական հեռանկար չունի: Այս մասին «Արմենպրես»-ի մամուլի սրահում հրավիրված ասուլիսին նշեց միջազգային իրավունքի փորձագետ Վլադիմիր Վարդանյանն` անդրադառնալով Անկարայից թուրք փաստաբան Մելիհ Աքքուրթի քայլին, ըստ որի, նա դիմել է Գերմանիայի Սահմանադրական դատարան Բունդեսթագի կողմից Հայոց ցեղասպանությունը ճանաչող բանաձևը չեղյալ համարելու հայցով:
«Գերմանիայի սահմանադրական արդարադատության համակարգի առանձնահատկություններից մեկն այն է, որ վերջինս բավական բարձր ընդունելության շեմ է նախատեսում դիմումների համար: Տվյալ պարագայում անձը, հաջողության հասնելու համար, պետք է հիմնավորի, որ այդ փաստաթուղթը խախտել է Սահմանադրությամբ երաշխավորված մի շարք իրավունքներից մեկը և պնդի, որ այդ փաստաթուղթն այդ առումով չի համապատասխանում Գերմանիայի հիմնական օրենքին ու պետք է վերանայվի: Այս պարագայում մենք չունենք նման խնդիր, որովհետև նախ բանաձևը խորհրադարանական է, այն չունի օրենքի մակարդակ, այն չի կարող ներգործություն ունենալ անձի նկատմամբ, առավել ևս խախտի որևէ անձի իրավունքները, այդ թվում, թուրք փաստաբանի, որը փորձում է նման եղանակով ուշադրության կենտրոնում պահել հիմնախնդիրը»,-ասաց Վլադիմիր Վարդանյանը: Նրա խոսքով, փաստաբանի կողմից այս քայլը լրացուցիչ փորձ է, որը թույլ կտա առնվազն խոսել նրա մասին, որ իրենք սպառել են բոլոր հնարավոր միջոցները հասնելու բանաձևի առ ոչինչ ճանաչմանը:
«Հետևաբար, դատական հեռանկար այս գործում չեմ տեսնում և գտնում եմ, որ Գերմանիայի Դաշնային Սահմանադրական դատարանը հստակ կարտահայտի իր դիրքորոշումն այս հարցի վերաբերյալ»,-ասաց միջազգային իրավունքի փորձագետը:
Գերմանիայի Բունդեսթագը հունիսի 2-ին ընդունեց Հայոց ցեղասպանության ճանաչման բանաձևը, որն ունի «1915 և 1916 թվականներին հայերի և մյուս քրիստոնյափոքրամասնությունների ցեղասպանության հիշատակի և ոգեկոչման մասին» անվանումը: Բանաձևն ընդունվեց ունենալով ընդամենը մեկ դեմ, մեկ ձեռնպահ ձայն:Ելույթ ունեցողները միաձայն ընդգծում էին անցյալի հետ առերեսման անհրաժեշտությունը, նաև` Հայաստանի և Թուրքիայի հաշտեցման գործընթացին նպաստելումղումները: Բունդեսթագում բարձրաձայնվել է Օսմանյան Թուրքիայի ոճրագործության մասին` նշելով, որ Գերմանիայի քայլը ոչ թե հայց է և մեղադրանք, < i>այլխոնարհում զոհերի հիշատակի առջև:
