Օֆշորային գոտիներից պետական գնումներին մասնակցության «վինտիլները» փակվում են

Պանամական փաստաթղթերի հրապարակումը վերջին լուրջ բացահայտումն էր օֆշորային գոտում գրանված ընկերությունների մասին: Այն աղմկահարույց էր նրանով, որ այդ փաստաթղթերը գաղտնի էին, իսկ գրանցված ընկերությունների սեփականատերերը` անհայտ:
Պետք է նշել, որ օֆշորային ընկերությունների սեփականատերերի և նրանց գործունեության հարցը քննարկման առարկա է դարձել նաև հայաստանյան տարբեր հարթակներում հատկապես այն պարագայում, երբ երբ «օֆշոր» հասկացությունը բացասաբար է ընկալվում քաղաքացիների կողմից` չնայած նրան, որ նրանք լիովին չեն պատկերացնում, թե ինչ է նշանակում այն:
Օֆշորային են համարվում այն տարածքները, որտեղ օտարերկրյա կապիտալի ներհոսք խթանելու նպատակով, բիզնեսի և օտարերկրյա ընկերությունների համար գործում են հատուկ պայմաններ` այդ թվում նաև դյուրին գրանցման համակարգ, տրամադրվում են հարկային և այլ արտոնություններ, հնարավորություն է ստեղծվում թաքցնել բիզնեսի իրական սեփականատերերին և այլն:
Օֆշորները հաճախ օգտագործվում են փողերի «լվացման», կոռուպցիայի, և խարդախ գործարքներ կնքելու համար, իսկ այս երևույթները կանխելու համար պետք է ձեռնարկվեն անհրաժեշտ քայլեր: Կոռուպցիայի դեմ պայքարի շրջանակներում Հայաստանը ևս քայլեր է կատարում այս ուղղությամբ: Մասնավորապես նախօրեին կայացած Կոռուպցիայի դեմ պայքարի խորհրդի հերթական նիստում հնչել են կոնկրետ առաջարկներ: «Իրավաբանների հայկական ասոցիացիա» ՀԿ-ի նախագահ Կարեն Զադոյանը ներկայացրել է պետական գնումների ոլորտում իրական սեփականատերերի ինստիտուտի ներդրման և օֆշորային գոտիներից պետական գնումներին մասնակցության արգելքի սահմանման հարցը:
Բանն այն է, որ շատ ընկերություններ, որոնց սեփականատերերը հայտնի չեն, գրանցվելով օֆշորային գոտիներում, հաղթում են ՀՀ-ում պետական գնումների մրցույթներ, իսկ ՀՀ օրենսդրությամբ որևէ արգելք նախատեսված չէ: Քանի որ նշված հանգամանքը կոռուպցիոն ռիսկերի տեղիք է տալիս, Զադոյանը առաջարկել է, որպեսզի կառավարությունը պարտադրի իր հետ պայմանագիր կնքել ցանկացող կազմակերպություններին բացահայտել իրական սեփականատերերին, ինչպես նաև պետք է հանրայնացվի վերջիններիս վերաբերյալ ինֆորմացիան:
Միջազգային փորձի ուսումնասիրությունը ցույց է տալիս, որ նման մոտեցման կիրառման դեպքում զգալիորեն կրճատվում են կոռուպցիոն ռիսկերը, և այդ հանգամանքը հաշվի առնելով` կառավարության ղեկավարը հանձնարարել է արդարադատության նախարարին՝ երկամսյա ժամկետում ներկայացնել համապատասխան օրենսդրական փաթեթ:
