Իրավաբան Տիգրան Սարգսյանն այսօր «Անդրադարձ» մամուլի ակումբում խոսել է սահմանադրական փոփոխությունների ռիսկային կողմերի մասին,-հայտնում է Past.am-ը:
 
Ըստ Սարգսյանի՝ սահմանադրական փոփոխությունները գրոհ են մարդու իրավունքների դեմ: «Եթե փոփոխությունները նախաձեռնում են իշխանությունները, հասկանալի է, որ դրանց նպատակը հենց իշխանության ընդլայնումն է: Իսկ արդյունավետ պետական կառավարում չի կարող լինել, եթե չկա ուժեղ նախագահի ինստիտուտը, որը կանգնած է իշխանության երեք՝ օրենսդիր, գործադիր և դատական թևերի գլխին»,- ընդգծեց բանախոսը:
 
Սարգսյանն ասաց, որ նախագահի ինստիտուտը կրելու է ձևական բնույթ, որովհետև նրան տրված չէ պետության գլխին հատուկ գործառույթներ: «ԶՈւ գերագույն հրամանատարի կարգավիճակը բոլոր երկրներում տրված է միայն պետության գլխին, իսկ այս փոփոխությաններով՝ վարչապետին: Սահմանադրական փոփոխությունների նախագծով պետությունը գլխատվում է: Մենք չենք ունենալու պետության գլուխ»,- նշեց իրավաբանը: Խորհդարանական կառավարման համակարգի մասին խոսելիս Սարգսյանը նշեց հետևյալը. «Եթե մենք չունենք օրենսդիր մարմին, ինչպե՞ս ենք անցնելու խորհրհդարանական կառավարման համակարգի»:
 
Տիգրան Սարգսյանը հավելեց, որ օրենսդրական նախաձեռնությունների պատկառելի մասը հենց հենց ՀՀ կառավարության կողմից է գալիս: Ըստ իրավաբանի՝ստացվում է, որ մեր օրենսդիր մարմինը ՀՀ կառավարությունն է, այլ ոչ թե Ազգային ժողովը:
 
Past.am-ի հարցին, թե ինչպե՞ս է վերաբերվում Վենետիկի հանձնաժողովի գնահատականներին, Տիգրան Սարգսյանը պատասխանեց, որ իրականում Վենետիկի հանձնաժողովը շատ սուր դիտողություններ է արել, իսկ մեզ մոտ ներկայացվում է՝ իբրև նախագիծը հավանության է արժանացել: «Իրականում այդպես չէ: Էթիկայից ելնելով՝ Վենետիկի հանձնաժողովը նշում է, որ ընդհանուր առմամբ՝ նախագիծը նորմալ է, բայց կան թերություններ: Նրանց մատնանշած գլխավոր թերություններից մեկն այն է, խորհրդարանը չի կարող ձևավորվել կրկնակի ընտրությունների միջոցով: Իսկ եթե դա հանվի, ապա կքանդվի ամբողջ նախագիծը, քանի որ նախագիծը կառուցված է դրա վրա»,- ասաց բանախոսը:
