Սյունիքի մարզի ընդհանուր իրավասության դատարանում հարուցվել է քրեական գործ՝ փոխգնդապետի կողմից ծառայության շահերին հակառակ գործողություններ կատարելու փաստի առթիվ:

Ըստ Դատական տեղեկատվական համակարգի՝ Լեռնային Ղարաբաղի թիվ Ն զորամասի փոխգնդապետ Վիտալի Դարյանին մեղադրանք է առաջադրվել այն բանի համար, որ նա անցնելով պաշտոնեական լիազորությունների սահմանները, հակառակ ծառայության շահերի, անձնական շահագրգռվածությունից ելնելով՝ թույլատրել է զինծառայողներ Դ. Բարսեղյանին, Լ.Պողոսյանին եւ Հ. Հարությունյանին բացակայել մարտական հերթապահությունից ավելի քան մեկ ժամ տեւողությամբ: Արդյունքում վերջիններիս բացակայությամբ ՀՀ օդային սահմանը թողնվել է առանց բավարար հսկողության, խախտվել է մարտական դիրքի մարտական հաշվարկը, որով էական վնաս է պատճառվել ծառայության շահերին:

Փոխգնդապետը մեղադրվում է Քրեական օրենսգրքի 375-րդ հոդվածի առաջին մասով, այն է՝ իշխանությունը չարաշահելը, իշխանազանցությունը կամ իշխանության անգործությունը: Վերջինիս սպառնում է երկուսից հինգ տարի ժամկետով ազատազրկում:
