Պաշտոնական փաստաթուղթ է կեղծել

Արաբկիր եւ Քանաքեռ-Զեյթուն վարչական շրրջանների ընդհանուր իրավասության դատարանում հարուցվել է քրեական գործ՝ պաշտոնեական գործունեություն իրկանացնող անձի կողմից իր դիրքը չարաշահելու եւ կեղծ արձանագրություն կազմելու փաստի առթիվ:
Ըստ Դատական տեղեկատվական համակարգի՝ Ստեփան Մուսիկյանը ընգրկված է եղել ՀՀ վերահսկիչ պալատի խորհրդի վերահսկողություն իրականացնող աշխատանքային խմբում, օժտված է եղել կարգադրիչ լիազորություններով:
Նրան մեղադրանք է առաջադրվել այն բանի համար, որ անձնական այլ շահագրգռվածությունից ելնելով՝ իրականությունը չափազանցնելու եւ բյուջետային միջոցների նկատմամբ արդյունավետ վերահսկողություն իրականացրած լինելու ու պետական շահը պաշտպանելու կեղծ շարժառիթով, ունենալով վերահսկողության առարկային առնչվող տեղեկություններն ու փաստերը անաչառ եւ համակողմանի հավաքագրելու եւ արձանագրելու, վերահսկողության ընթացքում հայտնաբերված փաստերն արձանագրելու եւ ստորագրելու, իչպես նաեւ՝ իր ծառայողական պարտականությունները բարեխղճորեն կատարելու եւ պետական շահը պաշտպանելու պարտականություններ, չի կատարել դրանք։
Պաշտոնեական դիրքը ծառայության շահերին հակառակ օգտագործելով՝ ակնհայտ կեղծ տեղեկություններ է մտցրել վերահսկողության ընթացքում կազմվող եւ ընթացիկ հաշվետվության հիմք հանդիսացող միջանկյալ փաստաթղթում՝ արձանագրության մեջ, եւ ստորագրել այն։
Այժմ նա մեղադրվում է Քրեական օրենսգրքի 308-րդ(Պաշտոնեական լիազորությունները չարաշահելը) եւ 314-րդ(Պաշտոնեական կեղծիքը) հոդվածների առաջին մասով: Առաջինը նախատեսում է տուգանք՝ նվազագույն աշխատավարձի երկուհարյուրապատիկից երեքհարյուրապատիկի չափով, կամ որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկում՝ առավելագույնը հինգ տարի ժամկետով, կամ կալանք՝ երկուսից երեք ամիս ժամկետով, կամ ազատազրկում՝ առավելագույնը չորս տարի ժամկետով: Իսկ երկրորդը պատժվում է տուգանքով՝ նվազագույն աշխատավարձի երկուհարյուրապատիկից չորսհարյուրապատիկի չափով, կամ ուղղիչ աշխատանքներով՝ մեկից երկու տարի ժամկետով, կամ կալանքով՝ մեկից երեք ամիս ժամկետով, կամ ազատազրկմամբ՝ առավելագույնը երկու տարի ժամկետով:
Այնուհետեւ գործն ըստ ընդդատության ուղարկվել է Կենտրոն եւ Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարան՝ հետագա քննության նպատակով: Սակայն վերջինիս նկատմամբ խափանման միջոց դեռեւս չի ընտրվել:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ,քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի`օրինական ուժի մեջ մտած դատավճռով:
