Վարչական իրավախախտումների օրենսգրքի նախագծին նվիրված քննարկում է անցկացվել

ՀՀ արդարադատության նախարարի առաջին տեղակալ Արսեն Մկրտչյանի գլխավորությամբ հուլիսի 29-31-ը տեղի է ունեցել կլոր-սեղան քննարկում` ՀՀ վարչական իրավախախտումների վերաբերյալ օրենսգրքի նախագծի շուրջ, որը կազմակերպվել էր Եվրոպական միության և Եվրոպայի խորհրդի համատեղ ծրագրի աջակցությամբ, ինչի գլխավոր նպատակն է ամրապնդել Հ այաստանի արդարադատության համակարգի անկախությունն ու բարելավել պրոֆեսիոնալիզմը: Այս մասին տեղեկացրին ՀՀ արդարադատության նախարարության տեղեկատվության և հասարակայնության հետ կապերի վարչությունից:

Աշխատանքային քննարկմանը մասնակցել են ԵԽ գրասենյակի ծրագրի ղեկավար Նարինե Գասպարյանը, ԵՊՀ Սահմանադրական իրավունքի ամբիոնի վարիչ Գևորգ Դանիելյանը, ՀՀ նախագահի աշխատակազմի, Ազգային Ժողովի, Գլխավոր դատախազության, Դատական դեպարտամենտի, Կենտրոնական բանկի ներկայացուցիչներ, Արդարադատության, Ֆինանսների, Առողջապահության, Կրթության և գիտության նախարարությունների, Մարդու իրավունքների պաշտպանության գրասենյակի և այլ պետական կառավարման ոլորտի աշխատակիցներ, ԵԽ փորձագետներ:

Արսեն Մկրտչյանը շնորհակալություն է հայտնել Եվրոպայի խորհրդի գրասենյակի ծրագրի ղեկավար Նարինե Գասպարյանին արդյունավետ համագործակցության համար,  օրենսգրքի լրամշակման աշխատանքներին ներգրավված բոլոր փորձագետներին, պետական կառավարման ոլորտի աշխատակիցներին և հորդորել վերջիններիս հանդես գալ նոր առաջարկություններով, որոնք կնպաստեն նախագծի կատարելագործմանը:

Եռօրյա աշխատանքային քննարկման ընթացքում ներկայացվել է ՀՀ վարչական իրավախախտումների վերաբերյալ օրենսգրքի նախագիծը` ընդհանուր և հատուկ մասերով:

Ընդհանուր մասում ներկայացվել են վարչական պատասխանատվության հիմնական սկզբունքները, վարչական իրավախախտումները և դրանց համար նախատեսվող վարչական տույժի տեսակները, տույժերի նշանակման ու կատարման կարգը, վարչական իրավախախտման վերաբերյալ վարույթի կարգը, վարչական իրավախախտման վերաբերյալ վարույթ հարուցելու և իրականացնելու իրավասությամբ օժտված մարմինները:

Հատուկ մասում առանձնացված և մանրամասն ներկայացվել են տարբեր ոլորտներին առնչվող վարչական իրավախախտման առանձնահատկությունները:

Վարչական իրավախախտումների օրենսգրքի նախագծի մշակման ընթացքում, մասնակիցները բաժանվել են խմբերի, որտեղ էլ քննարկվել են հատուկ մասում առկա՝ առողջապահության, կրթության և աշխատանքի, բնապահպանության, տնտեսական գործունեության, հարկային, տրանսպորտի և կապի և այլ ոլորտներում վարչական իրավախախտումները:

Օրենսգրքի նախագծի շուրջ կազմակերպված հանդիպման ընթացքում նաև ներկայացվել է ընդհանուր մասի վերաբերյալ եզրակացություն, որտեղ էլ ուսումնասիրվում է ընդհանուր մասի որոշ դրույթների համապատասխանությունը եվրոպական չափանիշներին, հատկապես ՝ Մարդու իրավունքների եվրոպական կոնվենցիային և հարակից այլ փաստաթղթերին:

Վարչական իրավախախտումների օրենսգրքի նախագիծը կառավարություն կներկայացվի օգոստոսի 29-ին:
