Կեղծ փաստաբանական ծառայություններ մատուցելու դիմաց 700 հազար դրամ է պահանջել

Երեւան քաղաքի Էրեբունի եւ Նուբարաշեն վարչական շրջանների ընդհանուր իրավասության դատարանում հարուցվել է քրեական գործ՝ կեղծ փաստաբանական ծառայություններ մատուցելու դիմաց քաղաքացուն 700 հազար դրամի չափով վնաս հասցնելու համար:
Ինչպես տեղեկանում ենք Դատական տեղեկատվական համակարգից, Խաչատուր Մարոզյանը, չհանդիսանալով ՀՀ Փաստաբանների պալատի անդամ եւ չունենալով դատական գործ վարելու պատշաճ ձեւակերպված լիազորություններ, այլ միայն հանդիսանալով «Իրավաբանների եւ հոգեբանների միջազգային ասոցիացիա» հասարակական կազմակերպության նախագահ՝ ոմն Ա. Հարությունյանի խոշոր չափերի գույքը խարդախությամբ հափշտակելու դիտավորությամբ, ներկայացել է որպես փաստաբան, խոստացել է վերջինիս պատկանող գույքի պետական գրանցում կատարելու նպատակով քաղաքացիական հայց ներկայացնել դատարան:
Խաչատուր Մարզոյանին մեղադրանք է առաջադրվել այն բանի համար, որ նա փաստաբանական գործունեություն իրականացնելու դիմաց պահանջել ու ստացել է խոշոր չափի` 700 հազար դրամ գումար` Ա. Հարությունյանին պատճառելով խոշոր չափի գույքային վնաս:
Վերջինս մեղադրվում է 178-րդ հոդվածի (Խարդախությունը) երկրորդ մասի երկրորդ կետի հատկանիշներով, ինչը պատժվում է նվազագույն աշխատավարձի չորսհարյուրապատիկից յոթհարյուրապատիկի չափով տուգանքով կամ երկուսից վեց տարի ժամկետով ազատազրկմամբ՝ նվազագույն աշխատավարձի առավելագույնը հիսնապատիկի չափով կամ առանց դրա:Նրան ստորագրությամբ ազատ են արձակել:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
