ՄԻՊ-ը ողջունում է Արմեն Մարտիրոսյանի խափանման միջոցը փոխելու մասին որոշումը

 ՀՀ Մարդու իրավունքների պաշտպանը ողջունում է Արմեն Մարտիրոսյանի կալանքի դեմ բողոքը բավարարելու և նրա խափանման միջոցը փոխելու մասին Վերաքննիչ դատարանի որոշման կայացումը: Այս մասին«Արմենպրես»-ին տեղեկացրին ՄԻՊ աշխատակազմից:

«Կալանքի՝ որպես անձին ազատությունից զրկելու հետ կապված հարկադրանքի միջոցի կիրառումը կարող է համարվել իրավաչափ միայն այն դեպքում, երբ քրեական վարույթի ընթացքում այդ անձի օրինական վարքագիծը հնարավոր չէ երաշխավորել կամ ապահովել ազատությունից զրկելու հետ չկապված այլ միջոցներով: Բացի այդ, կալանքը՝ որպես խափանման միջոց կիրառելու հարցը լուծելիս կարևոր նշանակություն պետք է ունենա անձի՝ հանցանք կատարելու կամ փախուստի դիմելու իրական հնարավորության գնահատումը կամ անձի կողմից իր վրա օրենքով կամ դատական ակտով դրված պարտականության կատաման ապահովման իրական անհրաժեշտությունը: Ընդ որում, կալանքի կիրառության հիմքերի առկայության հարցը գնահատելիս յուրաքանչյուր դեպքում անհրաժեշտ է ցուցաբերել անհատական մոտեցում՝ սկսած ենթադրյալ հանցանքին անձի առնչության աստիճանից մինչև նրա անձնական և ընտանեկան կյանքի հանգամանքների քննարկումը:

Անազատության մեջ պահելու հարցեր քննարկելիս նշված չափանիշները պետք է դառնան Հայաստանի իրավական կյանքի իրական մաս, իսկ դրանց լիարժեք կիրառությունը՝ արմատավորված անշրջելի պրակտիկա»,- նշված է ՄԻՊ աշխատակազմի հայտարարությունում:
