Այսօր՝ սեպտեմբերի 15-ին, արտակարգ իրավիճակ է ստեղծվել Երևան քաղաքի Մոլդովական 32/4 հարակից տարածքում գտնվող վագոն-տնակում բնակվող բնակիչների մոտ:

Ինչպես հայտնում է ֆոտոլրագրող Գագիկ Շամշյանը, ժամը 11:30-ի սահմաններում նշված հասցե էին ժամանել ՀՀ Արդարադատության նախարարության դատական ակտերի հարկադիր կատարումն ապահովող ծառայության աշխատակիցները, ովքեր պետք է նշված հասցեից վտարեին Հայրապետյանների 5 հոգանոց ընտանիքի անդամներին:

Ֆոտոլրագրողը հայտնում է, որ ընտանիքի մայրը բենզինի տարաներով բարձրացել էր տանիք և սպառնում էր, որ եթե վտարումն իրականացվի, (ինչը, ի դեպ՝ օրինական էր, քանի որ կա դատարանի որոշում), ապա ինքը ինքնահրկիզվելու է: Գրեթե մեկուկես ժամ Հարկադիր կատարողները համոզում էին, որպեսզի կինը իջնի տանիքից, իսկ հետո նրանց միացան ոստիկանության Նոր Նորքի բաժնի ծառայողները, ովքեր նույնպես համոզում էին կնոջը, սակայն նա չէր հանձնվում: Այնուամենայնիվ, տան անդամներից Աշոտ Հայրապետյանը հարկադիր կատարողներին տեղեկացրեց, որ իր փաստաբանը դատարանի որոշումը բողոքարկել է վերադաս դատարանին և խնդրեց, որպեսզի դատական կարգադրիչները գործողություններ չկատարեն, մինչև տեսեն՝ այսօր ինչ որոշում կկայացնի վերաքննիչ քաղաքացիական դատարանը:

Դատական կարգադրիչները ընդառաջելով Հայրապետյաններին՝ գրեթե մի քանի ժամ սպասեցին, որից հետո հայտնի դարձավ, որ նախագահող դատավոր Ա. Խարատյանի, դատավորներ Ա. Հունանյանի և Ս. Միքայելյանի գլխավորությամբ որոշում է կայացվել Նարգիս Ասլանյանի , Հրաչիկ Հայրապետյանի և Աշոտ Հայրապետյանի միջնորդությունը բավարարել, հարգելի համարել վերաքննիչ բողոք բերելու համար օրենքով սահմանված ժամկետի բացթողման պատճառները և այն վերականգնել և նրանց կողմից ներկայացված վերաքննիչ բողոքը ընդունել վարույթ՝ բողոքարկման քննությունը նշանակելով այս տարվա նոյեմբերի 3-ին: Այդ մասին իմանալով՝ դատական կարգադրիչները դադարեցրեցին իրենց օրինական պահանջները ներկայացնել Հայրապետյաններին:

Գ.Շամշյանի տեղեկություններով՝ ընտանիքը գտնվում է սոցիալապես անապահով պայմաններում և այդ մասին իմանալով՝ Երևանի քաղաքապետ Տարոն Մարգարյանը հանձնարարել է Նոր Նորք վարչական շրջանի ղեկավար Արմեն Ուլիխանյանին, որպեսզի ամեն անհրաժեշտ գործողությունները կատարվի՝ ընտանիքը փողոցում չհայտնվի: Ինչպես ավելի վաղ հայտնել էր ֆոտոլրագրողը, Երևան քաղաքի Մոլդովական 32/4 հարակից տարածքի հասցեում 2000 թվականից բնակվում է Հայրապետյանների 5 հոգանոց ընտանիքը: Նրանց քրտնաջան աշխատանքի շնորհիվ հողատարածքը մաքրվել է աղբից և քարակույտերից դեռ այն ժամանակ, իսկ վագոն տնակը, որը նոր-նոր է ապահովվել կոմունալ և կենցաղային չնչին հարմարություններով՝ պահարանով բաժանվել է երկու մասի՝ նորապսակների համար:

16 տարվա ընթացքում բազմիցս փորձել են հողատարածքը սեփականաշնորհել, բայց ինչ-ինչ պատճառաբանություններով չի հաջողվել և Ավան և Նոր Նորք վարչական շրջանների ընդհանուր իրավասության առաջին ատյանի դատարանը որոշում էր կայացրել առ այն, որ հողատարածքը պետք է ազատեն, քանի որ այն 2005 թվականին աճուրդով գնել էր ոմն Գագիկ:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
