«Ժամանակ». Սերժ Սարգսյանն ամբողջացրեց եռանկյունին

«Ժամանակ» թերթը գրում է. «Արթուր Դավթյանը ԱԺ քվեարկությամբ, 97 կողմ եւ 3 դեմ ձայնով, նշանակվեց Հայաստանի Հնրապետության գլխավոր դատախազ վեց տարի ժամկետով:
Հետաքրքրական է, որ գլխավոր դատախազի հերթական թեկնածությանը ԱԺ-ում դեմ է քվեարկել երեք պատգամավոր, ինչպես Գեւորգ Կոստանյանին գլխավոր դատախազ նշանակելիս: Այն ժամանակ քվեարկությունը դարձավ սկանդալային, երբ Նիկոլ Փաշինյանը լուսանկարեց իր քվեաթերթիկը, որից հետո առաջ եկավ հարցը, թե ինչպես է Սերժ Սարգսյանի ներկայացրած գլխավոր դատախազի թեկնածուին կողմ քվեարկել ընդդիմությունը: Այս անգամ, սակայն, կարծեք թե ոչ մի սկանդալ չկա, որ Սերժ Սարգսյանի ներկայացրած գլխավոր դատախազի թեկնածուի հարցում կա երեք ընդդիմադիր ձայն եւ 97 կողմ: Վերջիվերջո, մի քանի օր առաջ տեղի է ունեցել ընդդիմություն-իշխանություն կամ 3+2 համաձայնությունը Ընտրական օրենսգրիք շուրջ՝ մի կողմից ՀԱԿ-ի, ԲՀԿ-ի, ՕԵԿ-ի, իսկ մյուս կողմից՝ ՀՀԿ-ի եւ ՀՅԴ-ի միջեւ: Իսկ այդ համաձայնությունը, անկասկած, միայն Ընտրական օրենսգրքի շուրջ դրույթներ ու մոտեցումներ չէ, որ ներառում է, այլ նաեւ մի շարք այլ առանցքային խնդիրներ եւ, անկասկած, նաեւ գլխավոր դատախազի հարցը:
Տվյալ պարագայում բանն այն չէ, որ ՀՀԿ-ն չէր կարող ՀՅԴ-ի հետ միասին անցկացնել դատախազին, որին ներկայացրել էր Սերժ Սարգսյանը: Խնդիրն այն է, որ Սերժ Սարգսյանին նաեւ շատ կարեւոր է ստուգել, թե ինչպես է աշխատում «լայն կոնսենսուսը»:
Կոնսենսուսը փաստորեն աշխատում է: Իսկ ինչպես կաշխատի նոր գլխավոր դատախազը՝ ըստ էության այդ հարցում կարեւոր չէ ոչ մեկի համար, քանի որ այդ կառույցը ներկայումս դուրս է ներքաղաքական զարգացումների տրամաբանությունից, ֆունկցիոնալ առումով չկա այդ զարգացումների, այսպես ասած, ճանապարհային քարտեզում: Մյուս կողմից՝ այստեղ իհարկե նկատելի է նաեւ, որ Սերժ Սարգսյանն ըստ էության ամբողջացնում է իրավապահ «եռանկյունին»՝ ԱԱԾ, ոստիկանություն, գլխավոր դատախազություն, ամբողջացնում է այդ «եռանկյունու» վստահելիությունն իր հանդեպ, եւ սա թերեւս այն կոնսենսուսի գինն է, որ վճարվում է նախընտրական գործընթացի շուրջ փոխհամաձայնությունների համար:
Ըստ որում՝ այդ հարցում մեծ հաշվով ընդդիմադիր ալիքի բացակայությունը երեւի թե պայմանավորված է ոչ միայն դրա դիմաց նախընտրական կոմպրոմիսներ ստանալով,- վերջին հաշվով, Սերժ Սարգսյանն անկասկած որեւէ դեպքում չի գնա նախընտրական որեւէ լիարժեք երաշխիքի,- որքան նրանով, որ իրավապահ «եռանկյունին» ֆունկցիոնալ առումով ներկայումս ավելի շուտ Սարգսյանի ձեռքին գործիք է լինելու ներիշխանական, քան լայն ներքաղաքական հարցերում»:
