Իմ կարծիքը երեխաների նկատմամբ ծնողների կողմից բռնություն գործադրելու իրավական հետևանքի մասին
Երեկվանից լայն ու ծանր քննարկումներ են սկսվել այն տեսանյութի առթիվ, որտեղ մի կին այգում ապտակում է մինչև 6 տարեկան աղջկան: Ոստիկանությունից պարզեցին և հայտնեցին, որ ապտակողը երեխայի մայրն է:
Մի կողմից մենք գործ ունենք երեխայի նկատմամբ ծանր բռնություն կիրառելու հանցատեսակների հետ, մյուս կողմից գործ ունենք ծնող-երեխա կարևոր հարաբերության հետ:
Այսպիսով, հարցի լուծումն այպես եմ պատկերացնում. անհրաժեշտ է օրենսդրական նախաձեռնություն, որը հարցը կկարգավորի այսպես.
ծնողի կողմից անչափահաս երեխայի նկատմամբ ուժգին ցավ պատճառելու, ծեծելու կամ այլ բռնի գործողության դեպքում, որը չի առաջացրել մարմնական վնասվածք կամ քրեական օրենսգրքով նախատեսված այլ ծանր հետևանք, պետք է առաջացնի քրեական պատասխանատվություն.
1-ին անգամ՝ տուգանք և պետական հսկողություն (ՏԻՄ համապատասխան ստորաբաժանման կողմից)՝ 1-ից 3 տարի ժամկետով:
Կրկնվելու դեպքում կալանք՝ 1-ից 3 ամիս ժամկետով կամ ազատազրկում՝ 1-ից 3 տարի ժամկետով:
Այլ ծանրացուցիչ հանգամանքների դեպքում, որը կարելի է սահմանել, ազատազրկում՝ 3-ից 6 տարի ժամկետով...
Միաժամանակ, անհրաժեշտության դեպքում, պետք է իրավասու մարմինների կողմից քննարկվի ծնողական իրավունքից զրկելու հարցը:
