ՀՀ ՍԱՀՄԱՆԱԴՐԱԿԱՆ ԴԱՏԱՐԱՆԻ ԴԱՏԱՎՈՐԻ ԹԱՓՈՒՐ ՊԱՇՏՈՆԻՆ ՀՀ ՆԱԽԱԳԱՀԻ ԿՈՂՄԻՑ ԹԵԿՆԱԾՈՒ ԱՌԱՋԱԴՐԵԼՈՒ ԸՆԹԱՑԱԿԱՐԳԻ ՎԵՐԱԲԵՐՅԱԼ

Իրավապաշտպան Ռուբեն Մելիքյանը իր ֆեյսբուքյան էջում գրում է.
Մենք ուշադրությամբ հետևում ենք ՀՀ նախագահի 31.01.2019թ. ՆԿ-5-Ա կարգադրության հիման վրա իրականացվող գործընթացին։ Կրկնեմ, որ հարցի մեծ հանրային կարևորությունը պայմանավորված է Նախագահի կողմից առաջադրվող թեկնածուի՝ անխոցելի լեգիտիմություն ապահովելու հրամայականով։
Այս կապակցությամբ հանրային քննարկման առարկա են հետևյալ հարցերը.
1. Արդյոք երեք հավակնորդներից մեկին՝ 2018թ. հոկտեմբերին Նախագահի կողմից առաջադրված և 6-րդ գումարման Ազգային Ժողովի կողմից չընտրված թեկնածու Վահե Գրիգորյանին Նախագահի կողմից վերստին առաջադրելը կլինի իրավաչափ՝ հաշվի առնելով ՀՀ ազգային ժողովի կանոնակարգ - սահմանադրական օրենքի 141-րդ հոդվածը 8-րդ մասի այն կարգավորումը, որ եթե ՍԴ դատավորը չի ընտրվում, ապա իրավասու մարմինն առաջադրում է ՆՈՐ թեկնածու։ Այս կապակցությամբ առկա է նաև ՀՀ Սահմանադրական դատարանի կարևոր որոշում, որը մեկնաբանությամբ ներկայացնում եմ։ Մեկնաբանությամբ ներկայացնում եմ նաև նույն հարցի կապակցությամբ Վահե Գրիգորյանի և մյուս հավակնորդ Գոռ Հովհաննիսյանի դիրքորոշումները։
2. Արդյոք առհասարակ Նախագահի կարգադրությամբ սահմանված ընթացակարգն իրավաչափ է՝ ֆորմալ և բովանդակային առումներով։ Մասնավորապես՝ արդյոք Նախագահն իրավասու էր նման ընթացակարգ սահմանել, արդյոք Աշխատանքային խմբի կազմը և ձևավորման սկզբունքը ողջամիտ են, արդյոք Աշխատանքային խմբի գործունեության արդյունքները ողջամտորեն ստուգելի են, արդյոք աշխատանքային խմբին տրվել է հայտարարված նպատակին համարժեք գործիքակազմ, արդյոք պահանվել է Աշխատանքային խմբի գործունեության թափանցիկության չափանիշը։
