ԱՄՆ-ն ստիպված է լինելու օրինականացնել բազմակնությունը

Սուրեն Սարգսյանը ֆեյսբուքյան իր էջում գրում է.
2015 թվականին ԱՄՆ Գերագույն դատարանը «Obergefell v. Hodges» դատական գործում վճռեց, որ նույնասեռ ամուսնությունը մարդու անքակտելի իրավունքն է, և նման ամուսնության գրանցման մերժումը նահանգային և ֆեդերալ որևէ մարմնի կողմից ԱՄՆ Սահմանադրության խախտում է:
ԱՄՆ-ն սովորութային իրավունք կիրառող պետություն է, և դատարանը վճիռը կայացնելիս անպայման հաշվի է առնում իր կողմից կայացված վճռի ազդեցությունը իրավական համակարգի և դրա զարգացման վրա, ինչպես նաև այդ վճռի հնարավոր քաղաքական, սոցիալական, բարոյական և տնտեսական հետևանքները: Նույն սկզբունքներով էլ ԱՄՆ Գերագույն դատարանը առաջնորդվել է այս գործը քննելիս:
Վստահ եմ, որ վաղը որևէ արաբ մահմեդական, մորմոն, այլ կրոն դավանող կամ այլ սովորույթ կիրառող ԱՄՆ քաղաքացի դատական հայց է ներկայացնելու ընդդեմ ամուսնություն գրանցող մարմնի՝ պահանջելով գրանցել իրեն և իր երեք կանանց որպես օրինական ամուսին և կանայք: Եվ հենց նույն իրավական հիմքերով, ինչպես նաև կրոնի ազատության իրավունքը հաշվի առնելով՝ ԱՄՆ Գերագույն դատարանը պարտավոր է լինելու օրինականացնել բազմակնությունն ԱՄՆ-ում, երբ գործը հասնի իր վարույթին:
