Քրեական գործ՝ հողը փչացնելու և շրջակա միջավայրին էական վնաս պատճառելու համար

ՀՀ բնապահպանության նախարարության բնապահպանության և ընդերքի տեսչական 
մարմնից ստացված տեղեկատվության հիման վրա ՀՀ գլխավոր դատախազության 
պետական շահերի պաշտպանության վարչության կողմից կատարված 
ուսումնասիրությամբ պարզվել է, որ ՍՊ ընկերությունը ՀՀ Արագածոտնի մարզի 
Մաստարա համայնքի տարածքում կատարել է 250.000 խ/մ «հողածածկույթի» 
տեղափոխման հողային աշխատանքներ՝ ճանապարհաշինարարության համար որպես լիցք օգտագործելու նպատակով:

ՀՀ բնապահպանության նախարարությունն առարկություն չի ներկայացրել՝ 
պայմանով, որ պետք է պահպանվեն ՀՀ կառավարության 26.05.2006թ. թիվ 750-Ն, 
20.07.2006թ. թիվ 1026-Ն և 08.09.2011թ. թիվ 1936-Ն որոշումներով սահմանված 
պահանջներն ու նորմերը, որոնցով սահմանված են հողը հանելու, տեղափոխելու, 
պահպանելու և օգտագործելու կանոնները:

Ըստ ՀՀ կառավարության վերոհիշյալ որոշումների՝ «Հողամասերի սեփականատերերը, 
օգտագործողները պարտավոր են հողերի խախտման հետ կապված աշխատանքներ 
կատարելիս իրականացնել բերրի շերտի հանումը, պահպանումն ու օգտագործումը: 
Բերրի շերտը հանելու, պահեստավորելու և պահպանելու ընթացքում ձեռնարկվում 
են միջոցներ, որոնք բացառում են դրա որակական հատկանիշների վատթարացումը: 
Ջրային և հողմնային հողատարումից զերծ պահելու համար պահեստավորված 
հողաթմբերը ծածկվում են խոտաբույսերով կամ իրականացվում են այլ 
միջոցառումներ` հողաթմբերի ամրացում, ծածկում և այլն»:

Սակայն, ՍՊ ընկերության կողմից իրականացվող աշխատանքների ընթացքում՝ առանց 
թույլտվության, խախտելով հողը հանելու, տեղափոխելու, պահպանելու և 
օգտագործելու կանոնները, Մաստարա համայնքի ղեկավարի որոշմամբ տրամադրված 
հողակտորից դուրս, մոտ 1 հա չափով, կատարվել են լեռնային զանգվածի քանդման 
աշխատանքներ և դաշտամիջյան ճանապարհների կառուցում՝ ճանապարհի եզրերին, 
ինչպես նաև փորվածքի շրջակայքում առաջացնելով բուսահողի և տարբեր ապարներ 
պարունակող լեռնային զանգվածի կուտակումներ:

Արդյունքում, ՀՀ բնապահպանության նախարարության բնապահպանության և ընդերքի 
տեսչական տեսչական մարմնի կողմից արձանագրվել է, որ հողի բերրի շերտը 
դեգրադացվել է, գյուղատնտեսական նշանակության հողատեսքը փոխել է իր 
նշանակությունը, որի հետևանքով շրջակա միջավայրին պատճառվել է էական վնաս:

Նկատի ունենալով, որ արձանագրված խախտումներն առերևույթ պարունակում են 
հանցագործության հատկանիշներ՝ ՀՀ գլխավոր դատախազության պետական շահերի 
պաշտպանության վարչությունում ՀՀ քրեական օրենսգրքի 290-րդ հոդվածի 1-ին մասով նախատեսված հանցագործության հատկանիշներով հարուցվել է քրեական գործ, որի նախաքննության կատարումը հանձնարարվել է ՀՀ քննչական կոմիտեին:


Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է 
անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
