Արցախում պատիժը կրելուց հետո ադրբեջանցին ազատ է արձակվել

Արցախի ընդհանուր իրավասության առաջին ատյանի դատարանի 09.02.2018թ. դատավճռով 2 /երկու/ տարի ազատազրկման դատապարտված Էլնուր Էլման օղլի Հուսեյնզադեն Արցախի ոստիկանության ՔԿՎ քրեակատարողական հիմնարկում պատիժը կրելուց հետո, 2019թ. փետրվարի 2-ին ազատ է արձակվել:
Արցախի դատախազությունից հայտնում են, որ Էլնուր Էլման օղլի Հուսեյնզադեն մեղադրվում էր այն բանում, որ նա հանդիսանալով Ադրբեջանի Հանրապետության զինված ուժերի 157-րդ մոտոհրաձգային բրիգադի հետախուզական վաշտի զինծառայող, 2017թ. փետրվարի 1-ին, ժամը 15.00-ի սահմաններում, առանց պատշաճ թույլտվության Մարտակերտի շրջանի Թալիշ համայնքի ուղղությամբ ապօրինի հատել էր Արցախի Հանրապետության զինված ուժերի կողմից պահպանվող պետական սահմանը, մտել մարտական դիրքի խրամուղի, որից հետո ձերբակալվել էր պետական սահմանի հսկողությունն իրականացնող ստորաբաժանման ծառայողների կողմից:
Հիշեցնենք, որ 2017թ. փետրվարի 1-ին ԼՂՀ Մարտակերտի շրջանի Թալիշ համայնքի ուղղությամբ Ադրբեջանի Հանրապետության զինված ուժերի մի խումբ զինծառայողներ, օգտվելով մառախլապատ եղանակից, ձեռնարկել էին դիվերսիայի փորձ: Փորձը խափանվել էր Պաշտպանության բանակի` Արցախի պետական սահմանի պահպանությունն իրականացնող ստորաբաժանման կողմից: Նույն օրը` ժամը 15:00-ի սահմաններում, Պաշտպանության բանակի մարտական դիրքերից մեկի պահպանության տեղամասում հայտնաբերվել և ԼՂՀ ԱԱԾ բերման է ենթարկվել ԼՂՀ պահպանվող պետական սահմանն ապօրինի հատած դիվերսիոն խմբի անդամ, Ադրբեջանի Հանրապետության քաղաքացի, Ադրբեջանի Հանրապետության զինված ուժերի 157 մոտոհրաձային բրիադի հետախուզական վաշտի զինծառայող Էլնուր Էլման օղլը Հուսեյնզադեն:
Փաստի առթիվ հարուցվել էր քրեական գործ` ԼՂՀ Քրեական օրենսգրքի 33-317-րդ հոդվածով (դիվերսիայի փորձ կատարելը) եւ 350-րդ հոդվածի 1-ին մասով (Առանց սահմանված փաստաթղթերի կամ առանց պատշաճ թույլտվության Լեռնային Ղարաբաղի Հանրապետության պահպանվող պետական սահմանն ապօրինի հատելը): Փետրվարի 4-ին ԼՂՀ ընդհանուր իրավասության առաջին ատյանի դատարանը Էլնուր Հուսեյնզադեի նկատմամբ խափանման միջոց էր ընտրել երկամսյա կալանքը:
