Դատարանների շենքերի մուտքերը փակելու նախաձեռնության մասով Նիկոլ Փաշինյանը նշել է, որ դատական իշխանությունը նույնպես պատկանում է ժողովրդին, և ժողովուրդը իրավունք ուներ այդ կերպ իր բողոքը հայտնելու:

Մի կողմից՝ Փաշինյանի պնդումն աքսիոմատիկ ճշմարտություն է, որը բխում է ուղղակի ժողովրդավարության թեզից, մյուս կողմից՝ ժողովրդի մասնակցությունն իշխանության ձևավորմանը մանրամասն նկարագրված է Սահմանադրության տեքստում, և այս առումով Փաշինյանի ասածը նմանվում է պոպուլիզմի, մանավանդ, որ Մայր օրենքը թույլ չի տալիս, որ գործադիր իշխանությունը միջամտի արդարադատության իրականացմանը։ Ավելին՝ իշխանությունների բաժանման ու տարանջատման սկզբունքը ժողովրդավարության հիմնական նորմերից, հատկանիշներից մեկն է, ինչի անտեսումը, որպես կանոն, բերում է դիսկրիմինացիոն երևույթների։

Մյուս կողմից՝ ժողովրդի կամքը վերացական հասկացություն չէ, ու գոյություն ունեն դրա արտահայտման կոնկրետ լեգալ մեխանիզմներ, որոնցից իմպերատիվ բնույթ ունեն ընտրություններն ու հանրաքվեները։ Այս համատեքստում Փաշինյանի պնդումները ևս վիճահարույց են, որովհետև, օրինակ՝ դեկտեմբերի 9-ի արտահերթ ընտրություններում հասարակությունը վստահության ուժեղ մանդատ է տվել Փաշինյանի թիմին՝ ոչ թե դատարանների մուտքերն արգելափակելու, այլ կոնկրետ բարեփոխումներ իրականացնելու համար։

Շատ կարևոր է նաև, թե Փաշինյանը կոնկրետ ինչ է հասկանում «ժողովուրդ» հասկացության տակ։ Նախորդ օրվա «կոլցո» օպերացիային, ըստ փորձագիտական գնահատականների, մասնակցել է ընդամենը մի երկու հազար մարդ։ Առավելագույնը: Այս քանակին շատ դժվար է ժողովուրդ համարելը, ճիշտ հակառակը՝ եթե հիշենք, որ անցած տարի հոյկտեմբերի 2-ին Փաշինյանի կոչով խորհրդարանի շենքի մոտ հավաքվեցին մի քանի տասնյակ հազար քաղաքացիներ, ապա ստիպված ենք արձանագրել, որ մի քանի ամիսների ընթացքում գործող վարչապետի վարականիշը կտրուկ անկում է ապրել։ Մյուս կողմից՝ վարչապետի ծայրահեղ կոչերը այլևս հանրային աջակցություն չեն ստանում:

Սակայն խնդիրն ավելի գլոբալ համատեքստ ունի։

Այնպիսի տպավորություն է, որ Նիկոլ Փաշինյանը «համաժողովրդական աջակցության» մասին հիշում է՝ իր կառավարության մեկամյա անգործությունն արդարացնելու կամ իր ոչ այնքան օրինական քայլերը լեգիտիմացնելու համար։ Սակայն այս հարթության վրա վարչապետի այսօրվա մարտավարությունը, մեղմ ասած, արդյունավետ չէ, որովհետև հասարակության շրջանում էյֆորիկ տրամադրությունները նահանջել են, ու քաղաքացիներն ակնհայտորեն հոգնել են շոուներից, աղմկոտ ձերբակալություններից ու դատավարություններից՝ իրենց ձևավորած իշխանություններից ակնկալելով կոնկրետ արդյունքներ, գործողություններ։

Բացի այդ, երբ Նիկոլ Փաշինյանը «ժողովուրդ» է անվանում դատարանի մուտքերն արգելափակած փոքրաթիվ մարդկանց, ապա նա հերթական անգամ մասնատում, բարիկադավորում է հասարակությանը, որովհետև արդյո՞ք ժողովուրդ չեն այն մարդիկ, ովքեր որոշել են գնալ աշխատանքի՝ այսպիսով չտրվելով քաղաքական ավանտյուրային կամ ունեն քաղաքական այլ հայացքներ ու հարիր չեն համարում մասնակցել ակցիաների, որոնք դեմ են իրենց համոզմունքներին։
