Ի՞նչ կարծիք ունեք կայացված վճռի վերաբերյալ։

2019 թվականի հուլիսի 10-ին ընդհանուր իրավասության դատարանը` դատավոր Աիդա Դավթյանի նախագահությամբ կայացրեց «կանխատեսելի» վճիռ, որով մերժեց հայցվորի պահանջը։

Նախևառաջ դատավարության ամբողջ ընթացքում դատավոր Աիդա Դավթյանը չկարողացավ ապահովել Սեդրակ Քոչարյանի իրավունքների արդյունավետ դատական պաշտպանությունը` չնայած, որ փորձում էր պահպանել «ձևական կողմը»։ Դատարանը վարում էր դատավարությունը` չպահպանելով անաչառությունը։

Այս մեթոդաբանությունը լայնորեն կիրառվում է ներկայիս դատական պրակտիկայում, այսինքն` թոզ փչելով թե իբր ապահովվում է դատական պաշտպանությունը և արդար դատաքննության իրավունքը։ Ակնհայտ է, որ դատավոր Աիդա Դավթյանի կողմից խախտվել են որոշ դատավարության կանոններ, օրինակ` մրցակցության սկզբունքը։

Դատական ակտը ակնհայտորեն պատճառաբանված չէ։ Դատարանը կամընտրականորեն է անդրադառձել հայցվորի կողմից ներկայացված բանավոր բացատրություններին, հարցերին տրված պատասխաններում ներկայացված էական փաստարկներին, վկայակոչված իրավական հիմքերին և ներկայացված ապացույցներին։

Դատավոր Աիդա Դավթյանը դատական ակտը պատճառաբանել է ենթադրություններով, որը անթույլատրելի է։ Ավելին, դատական ակտը պատճառաբանվել է վերացական դատողություններով:
