Երևանի ընդհանուր իրավասության դատարանի Կենտրոն նստավայրում երեկ, ժամը 11։00-ին սկսվել է Գագիկ Ծառուկյանին կալանավորելու վերաբերյալ քննիչի միջնորդության քննությունը, որը սակայն հետաձգվել է դատական նիստին Գագիկ Ծառուկյանի և նրա պաշտպանների չներկայանալու պատճառով։
Հարկ ենք համարում նշել, որ ՀՀ քրեական դատավարության օրենսգրքի 285-րդ հոդվածի 2-րդ մասով սահմանված է, որ դատարանը պարտավոր է դատական նիստի տեղի և ժամանակի մասին պատշաճ ձևով ծանուցել միջնորդություն ներկայացրած անձին, մեղադրյալին, նրա օրինական ներկայացուցչին, պաշտպանին, եթե նա մասնակցում է գործին:
Ընդգծենք, որ Գագիկ Ծառուկյանը և նրա պաշտպանները պատշաճ կարգով ծանուցված չեն եղել դատական նիստի տեղի և ժամանակի մասին, ուստի հարգելի պատճառներով չեն ներկայացել դրան։
Չնայած որ նույն օրը ՀՀ բարձրագույն դատական խորհուրդը հաղորդագրություն է տարածել, թե իբրև Գագիկ Ծառուկյանը և նրա պաշտպանները ծանուցված են եղել դատական նիստի տեղի և ժամանակի վերաբերյալ, սակայն պետք է ընդգծել, որ նշված հաղորդագրութամբ ԲԴԽ-ն իրավացիորեն խուսափել է այդ ենթադրյալ ծանուցումները որպես պատշաճ գնահատելուց։

 

Ընդ որում, հարկ ենք համարում հատուկ նշել, որ նույն հոդվածի 2-րդ մասի համաձայն՝ ժամանակին ծանուցված ազատության մեջ գտնվող մեղադրյալի կամ պաշտպանի չներկայանալը չի խոչընդոտում միջնորդության քննմանը:
Քանի որ Գագիկ Ծառուկյանը գտնվում է ազատության մեջ, ուստի վերը նշվածն ուղիղ նշանակում է, որ եթե նա և պաշտպանները պատշաճ կարգով ծանուցված լինեին դատական նիստի տեղի և ժամանակի մասին, ապա դա խոչընդոտ չէր առանց վերջիններիս դատական նիստը շարունակելու համար։
Դժվար է պատկերացնել, որ պատշաճ ծանուցման ակայության դեպքում դատարանը և մյուս շահագրգիռ պետական մարմինները չէին օգտվի դատական նիստը Գագիկ Ծառուկյանի և նրա պաշտպանների բացակայությամբ իրականացնելու և նրա վերաբերյալ արագ կարգով կալանավորման որոշում կայացնելու այս հնարավորությունից, առավել ևս եթե ներկայացնենք պաշտպանության կողմի տրամադրության տակ եղած այն ապացույցները, որոնք ապացուցում են, որ մի շարք պետական մամիններ/պաշտոնատար անձինք/ վերաքննիչ դատարանի որոշումից հետո ակնհայտ կասկածելի և պրակտիկայից տարբերվող ջանասիրություն են ցուցաբերել, որպեսզի սույն միջնրդությունը հնարավորինս արագ կրկին քննվի առաջին ատյանի դատարանում և այն էլ իրենց նախընտրած դատավորի կողմից։

 

Վերջում ցանկանում ենք նշել, որ զանգվածային լրատվության միջոցներից տեղեկացել ենք, որ հաջորդ դատական նիստը նշանակվել է սեպտեմբերի 25-ին՝ ժամը 10:00-ին, ուստի արդեն իսկ տեղյակ լինելով դրա տեղի և ժամանակի վերաբերյալ, նշված օրը ներկայանալու ենք դատարան և օրենքով սահմանված կարգով իրացնելու ենք պաշտպանության իրավունքը։
