«Փաստ» օրաթերթը գրում է

ՀՀ արդարադատության նախարարությունը հանրային քննարկման է ներկայացրել ««Պետական պաշտոններ և պետական ծառայության պաշտոններ զբաղեցնող անձանց վարձատրության մասին» Հայաստանի Հանրապետության օրենքում լրացում և փոփոխություն կատարելու մասին» օրենքի նախագիծը, որով նախատեսվում է կայազորների զինվորական դատախազության դատախազներին, ծառայության առանձնահատկություններով պայմանավորված, տալ հավելումներ, որոնց վճարման դեպքերը, չափերը և կարգը սահմանում է Հայաստանի Հանրապետության կառավարությունը:

Հիմնավորման մեջ նշվում է. ««Պետական պաշտոններ և պետական ծառայության պաշտոններ զբաղեցնող անձանց վարձատրության մասին» Հայաստանի Հանրապետության օրենքի 14-րդ հոդվածի համաձայն՝

«1. Դատախազին վճարվում է հավելավճար դատախազի, դատախազության քննիչի, քննիչի պաշտոնում աշխատած, հատուկ քննչական ծառայությունում և (կամ) քննչական կոմիտեում ինքնավար պաշտոն զբաղեցնելու (այդ թվում՝ այդ պաշտոնը որպես պետական հատուկ ծառայող զբաղեցնելու) յուրաքանչյուր տարվա համար երկու տոկոսի չափով:

2. Դատախազը դասային աստիճանի համար ստանում է հավելավճար:

3. Դատախազներին վճարվող հավելավճարի ընդհանուր չափը չի կարող գերազանցել սույն օրենքի 6-րդ հոդվածի 2-րդ մասով սահմանված չափը»:

Նույն օրենքի15.1 հոդվածի համաձայն՝

«1. Քննչական կոմիտեի ծառայողին վճարվում է հավելավճար՝ քննչական կոմիտեի ծառայողի, հատուկ քննչական ծառայության ծառայողի, դատախազի, դատախազության քննիչի կամ քննիչի պաշտոնում աշխատած յուրաքանչյուր տարվա համար 2 տոկոսի չափով:

2. Քննչական կոմիտեի ծառայողը դասային աստիճանի համար ստանում է հավելավճար։

3. Քննչական կոմիտեի ծառայողին վճարվող հավելավճարի ընդհանուր չափը չի կարող գերազանցել սույն օրենքի 6-րդ հոդվածի 2-րդ մասով սահմանված չափը:

4. Քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության ծառայողներին, ծառայության առանձնահատկություններով պայմանավորված, տրվում են հավելումներ, որոնց վճարման դեպքերը, չափերը և կարգը սահմանում է Հայաստանի Հանրապետության կառավարությունը»:

Այսինքն, քննչական կոմիտեի սահմանային ստորաբաժանումներում ծառայություն իրականացնող զինվորական քննչական գլխավոր վարչության ծառայողները՝ պայմանավորված իրենց ծառայության առանձնահատկություններով, ստանում են հավելումներ՝ ՀՀ կառավարության 2014 թվականի սեպտեմբերի 4-ի N 950-Ն որոշմամբ սահմանված դեպքերում և չափերով, այնինչ հիշյալ ստորաբաժանումների քննիչների կողմից իրականացված նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող կայազորների զինվորական դատախազների համար օրենսդրությամբ նման իրավունք վերապահված չէ:

Հետևաբար, ըստ նախագծի հեղինակների, իրավական ակտի ընդունումը պայմանավորված է որոշակի խումբ դատախազների համար ևս լրացուցիչ սոցիալական երաշխիքներ սահմանելու անհրաժեշտությամբ՝ պայմանավորված վերջիններիս ծառայության առանձնահատկություններով, ինչպես նաև իրավապահ մարմինների աշխատակիցների նկատմամբ միասնական սոցիալական քաղաքականություն իրականացնելու նպատակով:
