Ինչպիսի հիմնավորումներով ՍԴ-ն որոշում կայացրեց. «Ժողովուրդ»

«Ժողովուրդ» օրաթերթը գրում է.
Սահմանադրական դատարանը երեկ հրապարակել է «Հայաստան» դաշինքի, «Զարթոնք» ազգային քրիստոնեական կուսակցության, «Հայոց հայրենիք» կուսակցության, «Պատիվ ունեմ» կուսակցությունների դաշինքի դիմումների հիման վրա ՀՀ կենտրոնական ընտրական հանձնաժողովի 2021 թվականի հունիսի 27-ի` «Հայաստանի Հանրապետության ազգային ժողովի 2021 թվականի հունիսի 20-ի արտահերթ ընտրությունների արդյունքներն ամփոփելու մասին» թիվ 184-ա որոշման հետ կապված վեճի վերաբերյալ գործով ամբողջական որոշումը։

Հիշեցնենք, որ նշյալ կուսակցություններն ու դաշինքները պահանջում էին անվավեր ճանաչել ԱԺ արտահերթ ընտրությունները, սակայն հուլիսի 17-ին Սահմանադրական դատարանն ուժի մեջ թողեց ԿԸՀ որոշումը, այսինքն՝ ԱԺ արտահերթ ընտրություններն անվավեր չճանաչվեցին։ «Ժողովուրդ» օրաթերթն ուսումնասիրել է ամբողջական որոշումը եւ առանձնացրել հետաքրքիր դրվագները:

Օրինակ՝ անդրադառնալով ընդդիմադիրների այն դիրքորոշմանը, թե հրաժարականից հետո Նիկոլ Փաշինյանը չէր կարող մնալ վարչապետի պաշտոնակատար, Սահմանադրական դատարանի եզրակացությունում ասված է. «Սահմանադրական դատարանը փաստում է, որ Կառավարության հրաժարականից հետո՝ մինչեւ նորանշանակ վարչապետի պաշտոնի ստանձնումը, Կառավարության անդամների պաշտոնավարման շարունակականության սահմանադրական պահանջը վերաբերում է ոչ թե վարչապետից բացի Կառավարության մյուս անդամներին, այլ Կառավարության բոլոր անդամներին՝ ներառյալ վարչապետի պաշտոնում նշանակված անձի պաշտոնավարմանը: Ն. Փաշինյանի՝ վարչապետի պաշտոնից հրաժարականից հետո վարչապետի պաշտոնում պաշտոնավարումը համահունչ է սահմանադրական կարգավորումներին»։

Անդրադառնալով իշխող ուժի կողմից վարչական ռեսուրսի կիրառման մասին դիմումներին՝ ՍԴ-ն գտել է. «Չի հիմնավորվում, որ վարչական ռեսուրսը Ազգային ժողովում քաղաքական մեծամասնություն ունեցող ուժի կողմից օգտագործվել է կազմակերպված եղանակով եւ ունեցել զանգվածային բնույթ, ուստի դրա օգտագործման համադրումը չի փաստում, որ այն որեւէ կերպ ազդել է ընտրությունների արդյունքների վրա»:

Նաեւ Սահմանադրական դատարանը, անդրադառնալով դիմողների վկայակոչած «Քաղաքացիական պայմանագիր» կուսակցության պատգամավորի թեկնածու Ն. Փաշինյանի կողմից կիրառված արտահայտությունների՝ Ազգային ժողովի արտահերթ ընտրությունների արդյունքների վրա ունեցած ազդեցության հարցին, գտնում է, որ դրա վերաբերյալ դիմողների պնդումները հիմնավոր չեն: Հավելենք, որ ՍԴ որոշումը բաղկացած է 87 էջից:
