Առողջապահության նախարարությունը միտումնավոր չի պարզաբանել, որ թեստավորման պատասխանը ներկայացնելու պարտավորությունն իրենց համար ոչ թե հոկտեմբերի 1-ից է, այլ 15-ից։ Այս մասին NEWS.am-ի հետ զրույցում ասաց իրավաբան Ռոբերտ Հայրապետյանը։

«Եթե մենք այս հարցով աղմուկ չբարձրացնեինք, ապա կարծում եմ՝ այսպես էլ կշարունակվեր, որովհետև մի շարք կազմակերպություններում քաղաքացիներն արդեն թեստավորվել էին։ Աշխատողները պետք է համապատասխան դիմում ներկայացնեն իրենց գործատուներին և պահանջեն, որ ամսի 15-ին վճարվելիք թեստի գումարը վճարի նա, որովհետև ըստ էության գործատուի մեղքով քաղաքացին իր վրա կրել է հավելյալ պատասխանատվություն։ Գործատուն էլ իր հերթին կարող է նույնաբովանդակ դիմում ներկայացնել առողջապահության նախարարության՝ պահանջելով դոտացիա։ Եթե մերժվի աշխատողի դիմումը, և եթե ինչ-որ աշխատող սեփական իրավունքների պաշտպանության համար պատրաստակամություն հայտնի թեստավորման համար հայց ներկայացնել գործատուի դեմ, կարծում եմ՝ այդ հայցադիմումը 90 և ավել % շանս ունի»,- նշեց նա։

<<Հայաստան>> դաշինքը օգոստոսի 24-ին դիմում է ներկայացրել Սահմանադրական դատարան՝ վիճարկելով նախարարի հրամանը։ Դաշինքը ներկայացրել է նաև միջնորդություն հրամանի կատարումը կասեցնելու վերաբերյալ մինչև քննության ավարտը։

<<Կարծում եմ՝ մոտ օրերս դատարանը միջնորդության վերաբերյալ որոշում կկայացնի, և արդյունքում կսպասենք Սահմանադրական դատարանի վերջնական որոշմանը։ Վարույթ ընդունելու ժամկետը 30 օր է, բայց հոկտեմբերի 14-ից աշխատողների վրա ազդելու պարտադիր թեստավորման կամ պատվաստման հակասահմանադրական և ապօրինի պարտավորությունը հաշվի առնելով, կարծում եմ՝ Սահմանադրական դատարանը որոշում կկայացնի ավելի սեղմ ժամանակահատվածում։ Եթե միջնորդությունը բավարարվի ամսի 15-ից հետո, իսկ քաղաքացիները թեստավորված լինեն ավելի վաղ, ապա որևէ մեխանիզմ չկա վերադարձնելու համար թեստավորման համար ծախսված գումարը, որովհետև այդ ժամանակ գործում էր նախարարի հրամանի նորմատիվ դրույթը>>,- ասաց Ռոբերտ Հայրապետյանը։

Իրավաբանի համար հարց է, թե պատվաստված մարդը, որը կարող է վարակել, և վարակվել, ինչու չպետք է թեստավորվի։

<<Եթե ես լինեմ պատվաստված անձ, լինեմ վիրուսակիր, բայց չունենամ հիմնավոր կասկած հետազոտվելու համար, ես կարող եմ ներկայանալ աշխատանքի և աշխատակցին, որը պարբերաբար ՊՇՌ թեստ է հանձնում, ուղղակի վարակեմ>>,- ընդգծեց Ռոբերտ Հայրապետյանը։

Ռոբերտ Հայրապետյանի խոսքով՝ նախարարի որոշման մեջ առկա է անուղղակի պարտադրանք, քանի որ պատվաստումին այլընտրանք ներկայացվում է վճարովի թեստավորումը։

<<Որոշման նպատակը զարգացնելը, գերշահույթով ապահովելն է թեստավորում իրականացնող ընկերություններին, և երկրորդ դեպքում անձանց տանել պատվաստման, որ եվրոպական կառույցներին ցույց տան, որ մենք ձեր պահանջները կատարել ենք, հնարավո՞ր է մի քանի միլիոն էլ մեզ գումար հատկացնեք>>,- ասաց Ռոբերտ Հայրապետյանը։
