«Երկու կարևոր նորություն. 1. ՊՇՌ հետազոտությունը քաղաքացու հաշվին չի կարող լինել. 2. պարզվում է պարտադրանք չկա

1. Սահմանադրական դատարանը Սահմանադրությանը հակասող և անվավեր է ճանաչել առողջապահության նախարարի հայտնի 65-Ն հրամանի այն դրութները, որոցով ՊՇՌ հետազոտությունը քաղաքացին իր հաշվին պետք է անցներ: ՍԴ-ն գտել է, որ առողջապահության նախարարությունը չի կարող վճարելու պարտականություն ունեցող սուբյեկտին սահմանել: Դա իր լիազորություններից դուրս է: Այս գործընթացը կազմակերպելու և ՍԴ-ում ներկայացնելու համար, հատուկ շնորհակալություն եմ հայտնում ԱԺ պատգամավոր Արամ Վարդևանյանին:

ՍԴ որոշումը հրապարակվելուց հետո հնարավոր կլինի կարծիք կազմել, սակայն մի բան պարզ է քաղաքացիների հաշվին այս ամիսների ՊՇՌ հետազոտություն իրականացնելու պարտադրանքը, լուրջ վնաս է հասցրել և քաղաքացիներին և առողջապահության նախարարության վարկանիշին: Սա պետք է ունենա իրավական և բարոյական հետևանք: Առողջապահության նախարարը և իրավասու անձինք պետք է պատասխան տան:

2. 2021թ. դեկտեմբերի 14-ին դիմել էի առողջապահության նախարարությանը խնդրելով հայտնել՝ եթե պարզվի, որ ՀՀ քաղաքացիները Covid-19 հիվանդության դեմ պատվաստվելու պատճառով մահացել են կամ նրանց առողջությանը վնաս է հասցվել, արդյոք ՀՀ առողջապահության նախարարությունը պատրաստ է նշված քաղաքացիների ոչ նյութական վնասը հատուցել:

Պատասխանը շատ «հուզիչ» է: Նշվել է (մեջբերում եմ)՝ «Ի պատասխան Ձեր՝ 2021 թվականի դեկտեմբերի 14-ի կորոնավիրուսային հիվանդության (COVID-19) դեմ պատվաստումների վերաբերյալ հարցման, տեղեկացնում եմ, որ Հայաստանի Հանրապետությունում կանխարգելիչ պատվաստումներն իրականացվում են կամավորության սկզբունքով:»:

Սիրելի հայրենակիցներ, հենց հարցը հասավ պատասխանատվությանը, պարզվում է, կամավորության սկզբունքով եք պատվաստվել: Ահա այն ինչը պետք է իմանանք:

Եթե կամավորության սկզբունք էր, ուրեմն կարող ենք և չպատվաստվել:

Հիշեցնում եմ, որ Ազատ կամք նախաձեռնությունը դեմ է պատվաստվման պարտադրանքին: Չի կարելի քաղաքացուն ստիպել պատվաստվել մի բանով, որը դեռ չի անցել փորձարկման բոլոր փուլերը և սահմանված կարգով գրանցում չի ստացել: Քաղաքացին ինքը պետք է որոշի իր կյանքը ռիսկի ենթարկել, թե՝ ոչ, այլ կերպ ասած դառնա փորձարկման օբյեկտ, թե՝ ոչ»:
