«Փաստ» օրաթերթը գրում է

«Դատական օրենսգիրք» սահմանադրական օրենքում փոփոխություններ և լրացումներ կատարելու մասին» սահմանադրական օրենքի և հարակից օրենքների նախագծերի ընդունմամբ ակնկալվում է ներդնել բարեվարքության պարբերական ստուգման մեխանիզմներ դատավորների, դատախազների և քննիչների համար: Բարեվարքության ստուգման կառուցակարգեր ՀՀ-ում ներդրվեցին 2020 թ.-ի մարտի 25-ին իրականացված օրենսդրական փոփոխություններով: «Կոռուպցիայի կանխարգելման հանձնաժողովի մասին» օրենքում ներդրվեցին բարեվարքության ուսումնասիրության կառուցակարգերը և սահմանվեց, որ բարեվարքության ուսումնասիրություն են անցնելու դատավորների թեկնածուները, ՍԴ-ի թեկնածուները, ԲԴԽ անդամի թեկնածուները, Վճռաբեկ դատարանում դատավոր նշանակվելու համար առաջխաղացման ենթակա դատավորների թեկնածուները և այլն:

2021-2022 թթ. իրականացված օրենսդրական մի շարք փոփոխություններով բարեվարքության ստուգման կառուցակարգեր նախատեսվեցին Հակակոռուպցիոն կոմիտեի ծառայողների թեկնածուների, Հակակոռուպցիոն դատարանի դատավորների թեկնածուների, Գլխավոր դատախազի թեկնածուի և այլ պաշտոնատար անձանց համար: Արդարադատության նախարարության ներկայացրած նախագծերով առաջարկվում է իրականացնել մի շարք փոփոխություններ, որոնք ուղղված են բարեվարքության ստուգման գործող կառուցակարգերի աստիճանական զարգացմանը և նոր ինստիտուտների ներդրմանը։

Օրինակ՝ նախագծերով առաջարկվում է բարեվարքության վերաբերյալ հարցաթերթիկում պարտադիր լրացման տվյալների շարքում ներառել անձի (թեկնածուի) և նրա ընտանիքի անդամների կենսագրական տվյալները՝ սահմանելով պահանջ նաև վերջին 5 տարվա ընթացքում կուսակցական պատկանելության վերաբերյալ տեղեկություններ ներկայացնելու վերաբերյալ: Հարցաթերթիկում լրացման ենթակա տվյալներ են նաև անձի ընտանիքի անդամների գույքային դրության՝ գույքի և եկամուտի վերաբերյալ ամփոփ տեղեկությունները: Նախագծերով առաջարկվում է Հանձնաժողովին հնարավորություն տալ անձի՝ կարգապահական, քրեական և վարչական պատասխանատվության ենթարկված լինելու վերաբերյալ տվյալներից բացի նաև պահանջել տեղեկություններ այն մասին, թե արդյո՞ք նրա մասնակցությամբ առկա է քաղաքացիական գործ կամ օրինական ուժի մեջ մտած վճիռ:

Առաջարկվում է ուսումնասիրության շրջանակը չսահմանափակել գրանցված խախտումներով, այլ հնարավորություն տալ Հանձնաժողովին ուսումնասիրել նաև այն դեպքերը, երբ առերևույթ խախտումներ առկա են, սակայն օրենսդրական բացերի, վաղեմության ժամկետների կամ այլ օբյեկտիվ պատճառներից ելնելով հնարավոր չի եղել դրանք որպես խախտում արձանագրել: Հանձնաժողովը բարեվարքության վերաբերյալ ուսումնասիրություն իրականացնելիս անձի՝ քրեական ենթամշակույթին հարելու հնարավորությունն ուսումնասիրելու նպատակով իրավասու է դիմել օպերատիվ-հետախուզական գործունեություն իրականացնող մարմիններին և ստանալ տեղեկություններ:
