Ի՞նչ ընթացքում է քրեական վարույթը. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Հոկտեմբերի 30-ին ՀՀ քննչական կոմիտեն հայտնեց, որ 2023 թ. սեպտեմբերի 19-ից հետո ԼՂում ունենք 200-ից ավելի զոհ, 42 անհետ կորած, գաղթելիս՝ 64 մահացած, 16 գերի: «Փաստ» թերթը դիմեց Քննչական կոմիտե՝ խնդրելով տեղեկություններ տրամադրել սեպտեմբերի 19-ից հետո Արցախից ՀՀ բռնագաղթի ճանապարհին մահացած 64 անձանց մասին, ինչպես նաև նրանց մահվան պատճառների և հանգամանքների մասին:
ՔԿ-ից «Փաստին» հայտնում են, որ ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության հատկապես կարևոր գործերի քննության վարչությունում Ադրբեջանի Հանրապետության ռազմաքաղաքական ղեկավարության կողմից 2023 թվականի սեպտեմբերի 19-ին Լեռնային Ղարաբաղի բնակչության նկատմամբ ազգային, էթնիկ կամ կրոնական խմբի լրիվ կամ մասնակի ոչնչացման նպատակով այդ խմբի անդամներին սպանելու, նրանց առողջությանը ծանր վնաս կամ հոգեկան լուրջ խեղում պատճառելու կամ այդ խմբի լրիվ կամ մասնակի ֆիզիկական ոչնչացմանն ուղղված կյանքի պայմաններ ստեղծելու, այդ թվում՝ բռնությամբ տեղահանելուն ուղղված միջոցներ իրականացնելու, մարդկության դեմ ուղղված հանցագործություններ, այդ թվում՝ քաղաքացիական անձանց դեմ ուղղված լայնածավալ կամ կանոնավոր հարձակման շրջանակներում սպանություն, բնաջնջում, ինչպես նաև ռասայական, ազգային, էթնիկ կամ սոցիալական ծագումով, կրոնով, քաղաքական կամ այլ հայացքներով կամ անձնական կամ սոցիալական բնույթի այլ հանգամանքներով պայմանավորված ատելության, անհանդուրժողականության կամ թշնամանքի շարժառիթով առևանգում կատարելու դեպքերի առթիվ ՀՀ քրեական օրենսգրքի 133- րդ հողվածի 1-ին մասով (ցեղասպանություն), 135-րդ հոդվածի 1-ին մասի 1-ին կետով և 191– րդ հոդվածի 2-րդ մասի 1-ին, 5-րդ, 6-րդ և 9-րդ կետերով նախաձեռնվել է քրեական վարույթ և իրականացվում է նախաքննություն։
Միևնույն ժամանակ, Քննչական կոմիտեի պատասխանում նշված է. «Հիմք ընդունելով ՀՀ քրեական դատավարության օրենսգրքի 186-րդ հոդվածի 2-րդ մասի և Տեղեկատվության ազատության մասին ՀՀ օրենքի 8-րդ հոդվածի 1-ին մասի 3– րդ կետի դրույթները՝ Ձեր կողմից ներկայացված հարցադրումների մասով տեղեկատվության տրամադրումը հնարավոր չէ, քանի որ պարունակում է հրապարակման ոչ ենթակա նախնական քննության տվյալներ»։
