Շանը ծեծելու և 5-րդ հարկից դուրս նետելու դեպքով քրեական վարույթ է նախաձեռնվել

Կենդանիների պաշտպանությամբ զբաղվող Hrants Ark հիմնադրամը ստորագրահավաք է կազմակերպել և պատրաստվում է դիմել Գլխավոր դատախազություն՝ վերջերս Երևանում տեղի ունեցած զարհուրելի դեպքի առնչությամբ, երբ ընտանիքի անդամներով՝ այդ թվում երեխան, ծեծի էին ենթարկել անօթևան շանը և ցած նետել 5-րդ հարկի պատշգամբից:
Հիմնադրամը պահանջում է , որ Գլխավոր դատախազությունը հետևողական լինի, որպեսզի Քննչական կոմիտեում կենդանիների նկատմամբ դաժան վերաբերմունքի հոդվածով քննվող գործը անուշադրության չմատնվի։
NEWS.am-ի հետ զրույցում կենդանիների պաշտպանությամբ զբաղվող հիմնադրամի տնօրեն Հրանտ Դավոյանը ասում է, որ կենդանիների նկատմամբ դաժան վերաբերմունքի հոդվածով քննվող գործերը սովորաբար կարճվում են, և մեղավորները չեն պատժվում:
«Որոշ ժամանակ առաջ մեր կամավորներից մեկը հաղորդում էր ներկայացրել ոստիկանություն և հայտնել, որ քաղաքացին շանը ծեծել էր և կրակել նրա վրա: Երկու շաբաթ առաջ դատարանում քննվում էր այդ գործը, դատարանը մեղավոր ճանաչեց քաղաքացուն և նրա նկատմամբ կիրառվեց տույժ: Դա առաջին դեպքն էր, երբ նման գործով որևէ մեկը պատասխանատվության երթարկվեց»,-պատմեց հիմնադրամի տնօրենը։
Հրանտ Դավոյանը չի կարծում, թե միջադեպի պատճառը եղել է շան հարձակումը, և նույնիսկ այդ դեպքում նա կենդանու նկատմամբ նման վերաբերմունքը անընդունելի է համարում: Ագրեսիվություն դրսևորող շան հանդիպելիս նա քաղաքացիներին խորհուրդ է տալիս դիմել քաղաքապետարանի թեժ գիծ և պահանջել հեռացնել տվյալ շանը իրենց տարածքից:
«Երևի թե երկրում տիրող իրավիճակով պայմանավորված մարդիկ ավելի դաժան են դարձել, բացի այդ բացակայում են կրթական ծրագրերը, որոնք կսովորեցնեն աշակերտներին և նրանց ծնողներին, թե ինչպիսին պետք է լինեն մարդկանց և կենդանիների միջև բալանսավորված փոխհարաբերությունները: Եթե, օրինակ, հոգեկան առողջության խնդիր ունեցող մարդը հարձակվի մեզ վրա, մենք չենք կարող չէ՞ տեղում հաշվեհարդար տեսնել, իսկ ինչո՞ւ անպաշտպան կենդանիների նկատմամբ կարող ենք նման կերպ վարվել »,-ասում է նա:
Հրանտ Դավոյանի խոսքով, խոսակցություններ կան, որ միջադեպին մասնակից է եղել նաև մի կին, որը ըստ երևույթին շանը պատշգամբից դուրս նետած տղամարդու կինն է:
Քննչական կոմիտեից NEWS.am-ին հայտնում են, որ գործով նախաձեռնվել է վարույթ քրեական օրենսգրքի 307-րդ հոդվածի 2-րդ մասին 1-ին կետով՝ այն է կենդանիների նկատմամբ դաժան վերաբերմունքը: Գործի շրջանականերում իրականացվում են քննչական գործողություններ, նաև հարցաքննություններ: Այս պահի դրությամբ դեռ քրեական հետապնդման ենթարկվող անձ չկա:
Քրեական օրենսգրքի կենդանիների նկատմամբ դաժան վերաբերմունքը պատժվում է տուգանքով` նվազագույն աշխատավարձի տասնապատիկից երեսնապատիկի չափով, կամ հանրային աշխատանքներով՝ հարյուրից երկու հարյուր ժամ տևողությամբ, կամ կարճաժամկետ ազատազրկմամբ՝ մեկից երկու ամիս ժամկետով, կամ ազատազրկմամբ՝ մեկից երեք տարի ժամկետով։
