Փաշինյանի խոստումը՝ Ալիևին

44-օրյա պատերազմի 4-րդ տարելիցից առաջ Նիկոլ Փաշինյանը ՄԱԿ Գլխավոր ասմաբլեայի ամբիոնից է Ադրբեջանին խոստացել փոխել ՀՀ Սահմանադրությունը։ Ըստ Փաշինյանի, Ադրբեջանը պնդում է, թե Խաղաղության պայմանագրին խոչընդոտում է Հայաստանի Հանրապետության Սահմանադրությունը, որն իբրև թե տարածքային պահանջներ է պարունակում Ադրբեջանի նկատմամբ: «Առանց մանրամասներին տրվելու ասեմ, որ մեր Սահմանադրության մեջ նման բան չկա, չկան տարածքային պահանջներ Ադրբեջանի նկատմամբ և ավելի մանրամասն գրավոր հիմնավորումներ կարող ենք տրամադրել այս հարցով հետաքրքրվող մեր բոլոր միջազգային գործընկերներին: Ասեմ ավելին, Ադրբեջանի Սահմանադրությունն է տարածքային պահանջներ պարունակում Հայաստանի Հանրապետության նկատմամբ և սրա մասին էլ կարող ենք գրավոր հիմնավորումներ ներկայացնել հարցով հետաքրքրվող մեր բոլոր միջազգային գործընկերներին»,- ասել է Փաշինյանն ու համենայն դեպս հավելել, թե հայկական կողմն Ադրբեջանի Սահմանադրությունը Խաղաղության պայմանագրի խոչընդոտ չի համարում այն պարզ պատճառով, որ Խաղաղության պայմանագրի նախագծի համաձայնեցված մասում ունենք ձևակերպում, որ լուծում է խնդիրը և այդ ձևակերպումը հետևյալն է. «Կողմերից ոչ մեկը չի կարող վկայակոչել իր ներքին օրենսդրության դրույթները՝ որպես հիմնավորում սույն Համաձայնագրի չկատարման համար»: Հետևաբար, պայմանագրի ստորագրումը կհասցեագրի թե՛ Հայաստանի, թե՛ Ադրբեջանի մտավախությունները և իրավական երաշխիքներ կստեղծի դրանց հիմնարար հասցեագրման համար»:
Փաշինյանը հայտարարել է, որ երբ խաղաղության պայմանագրի համաձայնեցված տեքստը դիտարկում են Հայաստանի Հանրապետության Սահմանադրությանը համապատասխանելու տեսանկյունից, ստանում են հետևյալ պատկերը: «Համաձայն Հայաստանի Սահմանադրության` Սահմանադրությանը հակասող համաձայնագրերը չեն կարող վավերացվել: Եվ ինչպես մնացած դեպքերում, Ադրբեջանի հետ Խաղաղության պայմանագիրը ստորագրելուց հետո մենք այն պետք է ուղարկենք Սահմանադրական դատարան, որպեսզի վերջինս պարզի համապատասխանությունը ՀՀ Սահմանադրությանը: Եթե մեր Սահմանադրական դատարանը կորոշի, որ Ադրբեջանի հետ Խաղաղության պայմանագիրը հակասում է ՀՀ Սահմանադրությանը (թեև մեր փորձագետները վստահեցնում են, որ դա հավանական չէ), այդ ժամանակ մենք կկանգնենք կոնկրետ իրավիճակի առաջ, որում սահմանադրական փոփոխություններ անհրաժեշտ կլինեն խաղաղության հասնելու համար»,- ասել է նա:
