ՀՀ Սահմանադրական դատարանը սեպտեմբերի 26-ի որոշմամբ ընդունել է, որ Հայաստանի և Ադրբեջանի սահմանազատման հանձնաժողովների համատեղ գործունեության կանոնակարգում ամրագրված պարտավորությունները համապատասխանում են ՀՀ Սահմանադրությանը։
 
Այս տխրահռչակ որոշումը հիմնված է Սահմանադրական դատարանի այն դիրքորոշման վրա, ըստ որի` իբրև թե ՀՀ և Արցախի վերամիավորումը չի կարող մեկնաբանվել որպես ՀՀ Անկախության հռչակագրում ձևակերպված նպատակ, և այդպիսով չի կարող ընկալվել որպես Հայաստանի Հանրապետության սահմանադրական պարտավորություն։
Սահմանադրական դատարանի դիրքորոշումը, որն ընկած է սույն որոշման հիմքում, կառուցված է մոլորեցնող, ակնհայտ քաղաքական ենթատեքստ ունեցող փաստարկների վրա, որոնցում ընտրողական ու սուբյեկտիվ մեկնաբանություններ են տրվել ՀՀ Սահմանադրության, ՀՀ Անկախության հռչակագրի և 1989 թ․ դեկտեմբերի 1-ի «Հայկական ԽՍՀ-ի և Լեռնային Ղարաբաղի վերամիավորման մասին» Հայկական ԽՍՀ Գերագույն խորհրդի և Լեռնային Ղարաբաղի Ազգային խորհրդի համատեղ որոշման դրույթների, այդ դրույթների միջև իրավական կապերի ու ազդեցությունների վերաբերյալ։
 
Սահմանադրական դատարանը, որը կոչված է ապահովելու սահմանադրական կարգ և կայունություն, Հայաստանի Հանրապետության սահմանադրաիրավական հիմքերի անսասանություն, այսպիսով գործող վարչախմբի պատվերով երկրում սահմանադրական հեղաշրջման մասնակիցն է դառնում։ Այս որոշումը ոչ միայն ծանր հարված է հասցնում Արցախի ժողովրդի ինքնորոշման իրավունքի իրացման, Մայր հայրենիքի հետ վերամիավորման հարցում Հայաստանի Հանրապետության իրավատիրությանը, այլև հղի է Հայոց պետականության կորստի վտանգներով։
 
Պատահական չէ, որ որոշումն ընդունելուն մասնակցել են Սահմանադրական դատարանի այն դատավորները, որոնց ընտրությունը տեղի է ունեցել 2020 թ․ ԱԺ ապօրինի որոշման հիման վրա` Սահմանադրական դատարանի փաստացի բռնազավթման հետևանքով, ինչը հիմք է տալիս ապագայում առոչինչ ճանաչելու այս որոշումը։
 
«ՀայաՔվե» քաղաքացիական նախաձեռնության խորհուրդը հայտարարում է, որ Սահմանադրական դատարանի սեպտեմբերի 26-ի ապօրինի որոշումը Հայաստանի Հանրապետությունում սահմանադրական կարգի տապալման, պետական իշխանության բոլոր ճյուղերի յուրացման հերթական վկայությունն է։ Իսկ ՀՀ Սահմանադրական դատարանի այն դատավորները, ովքեր իրենց ապօրինի որոշմամբ մաս են կազմել գործող վարչախմբի հակապետական գործողություններին, իրենց դրանով դուրս են դրել օրենքի և օրինականության սահմաններից և անխուսափելիորեն պատասխանատվության են ենթարկվելու սահմանադրական կարգի փաստացի տապալման փորձի համար:
 
Կոչ ենք անում Ազգային Ժողովի բոլոր այն պատգամավորներին, ովքեր իրենց իրապես կաշկանդված չեն համարում հրամայական մանդատով, առաջնորդվում են սեփական խղճով ևՀայաստանի Հանրապետության ազգային-պետական շահերով, չվավերացնել ներկայացված կանոնակարգը, իսկ ԱԺ իշխող մեծամասնության կողմից վավերացման պարագայում դիտարկել մանդատները վայր դնելու հնարավորությունը և դրանով ձախողել Հայաստանի Հանրապետության կապիտուլյացիայի հետագա գործընթացը։
