Այն, ինչը կատարվում է աբսուրդի ժանրից է և ընդհանրապես կապ չունի իրավաբանության հետ։ Այս մասին այսօր՝ հոկտեմբերի 11-ին, դատարանի բակում լրագրողների հետ զրույցում ասաց ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանն՝ անդրադառնալով իր վերաբերյալ քրեական գործը կրկին վերաբացելուն։
«Երեք տարի այս գործը պահել են Վճռաբեկ դատարանում, Սահամանդրական դատարանի կազմը փոխելու օպերացիան ավարտել են, հետո Սահամանդրական դատարանը կայացրեց շատ տարօրինակ որոշումը. այսպես ասած՝ մշակվել էր մի օպերացիա, որը տևեց 3 տարի»,- ասաց երկրորդ նախագահը։
Ռոբերտ Քոչարյանը շեշտեց, որ Սահամանդրական դատարանում այս որոշմանը քվեարկել են դատավորներ, որոնք քվեարկելու իրավունք չեն ունեցել. «Ե՛վ Վահե Գրիգորյանը, և՛ Սասուն Խաչատրյանի եղբայրը։ Հրայր Թովմասյանին չեն թույլատրել մասնակցելու այդ հարցի քննարկմանը՝ հետաքրքիր պատճառաբանությամբ, թե իմ փաստաբան Արամ Օրբելյանի հետ Թովմասյանն ունի քավոր–սանիկական հարաբերություններ, իսկ հարազատ եղբայրությունը, պարզվում է, խոչընդոտող հանգամանք չէ»։
Անդրադառնալով Հակակոռուպցիոն դատարանում վերաբացված գործին՝ երկորրդ նախագահն ասաց. «Ամեն ինչ բաց է լինելու։ Չկա մեղադրանք, տեսել եք՝ ես որտեղ եմ նստած եղել այս դատական նիստին։ Իմ տպավորությամբ՝ այս գործն այս վիճակում ուղղակի գցել են դատարանի գրպանը՝ լուծում գտնելու համար, իսկ օրինական լուծում այս վիճակից ուղղակի չկա։ Ես չգիտեմ՝ դատավորն ինչպես կտանի դատավարությունը, եկեք սպասենք, չեմ կարող դատավորի անունից խոսել։ Եթե ունենա համարձակություն, ապա պետք է ուղղակի կարճի այս գործը»։
Անդրադառնալով դատավորի՝ նախկինում ՔՊ անդամ լինելու հանգամանքին՝ Ռոբերտ Քոչարյանն ընդգծեց, որ եթե այս դատական նիստը շարունակվի, ապա կլինի դատավորին ինքնաբացարկի միջնորդություն. «Այդ միջնորդության մասին նաև այդ հանգամանքը փաստաբանները կնշեն»։
Հարցին՝ արդյո՞ք ինքը չունի մտավախություն նորից կալանավորվելու, Ռոբերտ Քոչարյանն արձագանքեց. «Դուք չե՞ք նկատել, որ ես նման բաներից չեմ վախենում»։
Հարցին՝ այժմ կա՞ «զանգովի արդարադատություն», Ռոբերտ Քոչարյանն արձագանքեց՝ իսկ ընդհանրապես արդարադատություն կա՞.
«Ես ավելի քան 1.5 տարի կալանավորված եմ եղել ապօրինաբար, չեղած հոդվածով, և մինչև հիմա ինձնից ոչ դատախազությունը կամ որևէ այլ մարմին ներողություն չի խնդրել։ Ավելին, շարունակում են աճպարարությամբ այս գործը հետ բերել դատարան՝ ինչ–ինչ նպատակներով։ Այն, ինչ կատարվում է իրավական խուլիգանություն է։ Ոչ միայն այս գործի հետ կապված, տեսնում եք կալանավորների ու քաղաքական հետապնդումների քանակը»։
