Եթե Հայաստանն իրեն հարգող իրավապահ համակարգ ունենար, ապա ՀՀ վաչապետի պաշտոնը զբաղեցնող անձն արդեն ձերբակալված կլիներ ՀՀ Քրեական օրենսգրքի 136 հոդվածի համաձայն։

2018թ. իշխանափոխությունից հետո Նիկոլ Փաշինյանն ու իր թիմը բազմիցս են քայլեր կատարել Հայոց ցեղասանության միջազգային ճանաչման գործընթացի դեմ՝ փաստացի ապացուցելով, որ շարքային թրքական գործակալներ են։ Պատմությունը խմբագրելու նրանց մղումներն այնքան հեռուն են գնացել, որ նույնիսկ ամենամեծ ոճրագործությունը փաշինյանականների համար քննարկման առարկա է դարձել։ Օրերս շվեյցարահայ համայնքի հետ հանդիպմանը Նիկոլ Փաշինյանը կրկին կասկածի տակ է դրել Հայոց ցեղասպանության փաստը, հայտարարել, թե պետք է դեռ հասկանալ՝ ի՞նչ է տեղի ունեցել Հայոց ցեղասպանության ժամանակ, ինչու՞ և ու՞մ միջոցով ենք ընկալել Հայոց ցեղասպանությունը։

Ցուցադրելով իր պատմական և իրավական գիտելիքների իսպառ բացակայությունը՝ Փաշինյանը հայտարարել է. «Մենք Հայոց ցեղասպանության պատմությանն էլ պետք է վերադառնանք, պետք է հասկանանք, լավ՝ ի՞նչ է տեղի ունեցել և ինչու՞ է տեղի ունեցել, և ինչպե՞ս ենք մենք դա ընկալել, ու՞մ միջոցով ենք ընկալել, ո՞նց է, որ 1939 թվին Հայոց ցեղասպանության օրակարգ չի եղել, և ո՞նց է որ1950-ին Հայոց ցեղասպանության օրակարգ հայտնվել է: Սա մենք պե՞տք է հասկանանք, թե՞ չպետք է հասկանանք»։

Ո՛չ Փաշինյանը, ո՚չ նրա կիսագրագետների խմբակը, իհարկե, տեղյակ չեն, որ «ցեղասպանություն» եզրույթն առաջին անգամ ի հայտ է եկել միայն 1943թ., երբ լեհ իրավաբան Ռաֆայել Լեմկինը ձևակերպեց այն։ «Ես ստեղծեցի այդ բառը, որովհետև մեզ պետք էր ինչ-որ մի բնորոշում, որպեսզի մենք կարողանայինք հասկանալ՝ ի՞նչ էր այն, ի՞նչ կատարեցին թուրքերը հայերի և նացիստները հրեաների հետ»,- նշել էր Լեմկինը։

Թե՛ աշխարհահռչակ իրավաբանի ձևակերպումը, թե՛ ՀՀ Քրեական օրենսգիրքը Նիկոլ Փաշինյանի համար խոչընդոտ չեն՝ տրվելու թուրքական ժխտողական քաղաքականությանը:

Քրեական օրենսգրքի 136 հոդվածի 2-րդ մասը բառացի նշում է. «Ցեղասպանությունը կամ մարդկայնության դեմ ուղղված հանցագործությունները հրապարակայնորեն հերքելը, արդարացնելը, դրանք քարոզելը կամ դրանց վտանգավորությունը նսեմացնելը, որը կատարվել է՝

1) հրապարակայնորեն ցուցադրվող ստեղծագործություններով, զանգվածային լրատվության միջոցներով կամ տեղեկատվական կամ հաղորդակցական տեխնոլոգիաներն օգտագործելով կամ 2) իշխանական կամ ծառայողական լիազորությունները կամ դրանցով պայմանավորված ազդեցությունն օգտագործելով՝ պատժվում է ազատազրկմամբ՝ երկուսից հինգ տարի ժամկետով»:

Գործող իրավապահ համակարգը, բնականաբար, Փաշինյանին պատասխանատվության չի ենթարկի, բայց իշխանափոխությունից հետո նրան մեղսագրվող հոդվածների թիվն ավելացավ ևս մեկով։
