Շարունակելու ենք բարձրաձայնել Ադրբեջանի դատական համակարգի խնդիրները․ ՀՀ դատավորների միություն

Դեռևս 2024 թվականի հոկտեմբերին Քեյփ Թաունում տեղի ունեցած Դատավորների միջազգային միության (IAJ) համաժողովին ընդառաջ, անդամակցող 94 երկրների պատվիրակներին տրամադրվել է ՀՀ դատավորների միության դիրքորոշումը, և քննարկումների ժամանակ բարձրաձայնվել են Ադրբեջանի դատական համակարգի անկախության բացակայության, դատական համակարգի նկատմամբ քաղաքական լիակատար վերահսկողության, մարդու իրավունքների կոպիտ խախտումների, խոշտանգումների, պատերազմական հանցագործությունների, դատական համակարգի կոռումպացվածության, քաղաքական հետապնդումների, իրավապաշտպանների նկատմամբ ճնշումների և միջազգային հեղինակավոր կազմակերպությունների եզրակացությունների վերաբերյալ հարցերը։
Փաստարկված կերպով բարձրաձայնվել է, որ ոչ միայն դատական համակարգը, այլև նույնիսկ այդ պետության դատավորների միությունն է գտնվում քաղաքական իշխանության ուղղակի ազդեցության տակ։ Ոչ միայն չի գործում անկախ դատական համակարգ, այլև գեթ մեկ անկախ դատավոր չկա։
Այս համատեքստում, ադրբեջանական բանտերում և դատարաններում գտնվող հայ գերիների (Արցախի նախկին պետնախարար Ռուբեն Վարդանյանի և մյուսների) նկատմամբ իրականացվող խոշտանգումների ու անմարդկային վերաբերմունքի մասին հավաստի հաղորդումներն ու փաստարկներն ավելի են խորացնում և հաստատում բարձրաձայնված մտահոգությունները։
Մասնավորապես, հայ ռազմագերիների միջազգայնորեն ճանաչված իրավունքների, այդ թվում՝ արդար դատաքննության իրավունքի կոպիտ խախտումներն այնպիսի ծավալների են հասել, որ նվազագույն արդարադատության ակնկալիքը բացակայում է։
Ի հավելումն, արդեն իսկ փաստագրված են խոշտանգումների և դաժան, անմարդկային վերաբերմունքի մասին հաղորդումները։
ՀՀ դատավորների միությունը շարունակելու է հետևողականորեն բարձրաձայնել այս խնդիրները միջազգային գործընկերների շրջանակում և հղել հասցեական հարցադրումներ՝ նպատակ ունենալով ապահովել արդարադատության և մարդու իրավունքների պաշտպանությունը։
