Ռուբեն Վարդանյանի գործով գանգատ է ներկայացվել Մարդու իրավունքների եվրոպական դատարան: Այս մասին հայտնում են «Ռուբեն Վարդանյան» հիմնադրամից:
«Ս. թ. հուլիսի 19-ին իմ կողմից պաշտոնական գանգատ է ներկայացվել Մարդու իրավունքների եվրոպական դատարան (ՄԻԵԴ) ՝ ՀՀ քաղաքացի, ներկայումս Ադրբեջանի Ումբակի քրեակատարողական համալիրում պահվող Ռուբեն Վարդանյանի գործի վերաբերյալ: ՄԻԵԴ-ում հանդես եմ գալու Ռուբեն Վարդանյանի շահերի պաշտպանությամբ:
Գանգատում մանրամասնորեն նկարագրված են Մարդու իրավունքների և հիմնական ազատություների պաշտպանության մասին կոնվենցիայի (Կոնվենցիա) ութ հոդվածների խախտումները և բերված են դրանք հաստատող հիմնավորումներ:
Ռուբեն Վարդանյանի գործով դատավճիռը Բաքվի ռազմական դատարանը հրապարակել էր 2026 թվականի փետրվարի 17-ին՝ նրան դատապարտելով 20 տարվա ազատազրկման: Դատարանը դատավճիռն ամբողջությամբ չէր ընթերցել։
Ավելի ուշ, ընտանիքի միջոցով հասանելի դարձած դատավճռից պարզ է դարձել, որ Վարդանյանը «մեղավոր» է ճանաչվել 41 դրվագով՝ Ադրբեջանի Հանրապետության քրեական օրենսգրքի 21 հոդվածների հիման վրա։
Դատավճռում Վարդանյանի անհատական մեղքը չի հիմնավորվել փաստերով կամ ապացույցներով։ Փոխարենը դատարանը եզրակացրել է, որ «հանցավոր համայնքը»՝ Արցախի չճանաչված վարչակազմը, Լեռնային Ղարաբաղում գործել է 1988 թվականից, և որ Վարդանյանը միացել է այդ «համայնքին» 2020 թվականի դեկտեմբերին, թեև այդ ժամանակ նա բնակվում էր Մոսկվայում։
Վարդանյանի կողմից քաղաքացիական վարչական պաշտոնի ընդունումը դատարանը գնահատել է որպես իշխանության բռնի զավթում, նրա առևտրային և բարեգործական գործունեությունը՝ որպես ապօրինի ձեռնարկատիրություն և ահաբեկչության ֆինանսավորում, իսկ Լաչինի միջանցքով Լեռնային Ղարաբաղ մուտք գործելը՝ որպես Ադրբեջանի պետական սահմանն ապօրինի հատել։
Վարդանյանը չի բողոքարկել դատավճիռը, քանի որ համարել է, որ դատավարությունը եղել է բեմադրված և կանխորոշված, իսկ ներպետական բոլոր միջոցները՝ անարդյունավետ:
Իրականում անկարելի է պաշտպանել իրավունքները մի համակարգում, որն ի սկզբանե մերժում է արդար դատաքննության իրավունքը։ Ուստի Ռուբեն Վարդանյանը որոշում է կայացրել արդարության համար պայքարը շարունակել միջազգային իրավական մեխանիզմների միջոցով:
