2027 թ.-ի հունվարի 1-ից հետադարձ հիփոթեքի պայմանագրով ստացվող ամենամսյա վճարումները եկամտային հարկով չեն հարկվի։ Այդ օրվանից սկսում է գործել նաև հետադարձ հիփոթեքի ինստիտուտը, որով կենսաթոշակային տարիքի հասած սեփականատերը կարող է գրավ դնել իր բնակարանը կամ տունը և բանկից ամսական գումար ստանալ՝ շարունակելով ապրել այնտեղ։

 

Ինչպես տեղեկացնում է  Iravaban.net-ը, հարկային կանոնը սահմանված է 2026 թ.-ի հուլիսի 3-ի ՀՕ-323-Ն օրենքով, որը Հարկային օրենսգրքի 147-րդ հոդվածի 1-ին մասը՝ նվազեցվող (չհարկվող) եկամուտների ցանկը, լրացնում է 19.1-ին կետով՝ «հետադարձ հիպոտեկի պայմանագրի շրջանակներում ստացվող պարբերական ամենամսյա վճարումները»։

 

Ո՞վ կարող է կնքել պայմանագիրը

 

Քաղաքացիական օրենսգրքի 272.2-րդ և 272.3-րդ հոդվածների համաձայն՝ գրավատուն պետք է հասած լինի տարիքային աշխատանքային կենսաթոշակի տարիքին և լինի բնակարանի, բնակելի տան, այգետնակի կամ ամառանոցի սեփականատերը։ Գույքը պայմանագիր կնքելու պահին չպետք է ծանրաբեռնված լինի երրորդ անձանց իրավունքներով։ Ամուսինների ընդհանուր գույքի դեպքում երկու ամուսինն էլ պետք է հասած լինեն կենսաթոշակային տարիքին, և գույքը պետք է գրանցված լինի ամուսնու բացառիկ սեփականության իրավունքով։

 

Պայմանագիրը ենթակա է նոտարական վավերացման, իսկ բանկը պարտավոր է այն կնքելուց առնվազն 10 օր առաջ անցկացնել պարտադիր խորհրդատվություն։

 

Ինչպե՞ս պետք է ծախսել ստացված գումարը

 

Գումարը տրամադրվում է հատուկ բանկային հաշվի միջոցով։ Ստացված վճարների 80 տոկոսը պետք է օգտագործվի բացառապես անկանխիկ եղանակով՝ պայմանագրով նշված հաշվից։ Այդ վճարների հաշվին պետք է ժամանակին վճարվեն նաև բնակարանի հարկերն ու պարտադիր վճարումները (272.7-րդ հոդված)։

 

Իսկ եթե բնակարանն անցնի բանկին

 

Նույն ՀՕ-323-Ն օրենքով 2027 թ.-ի հունվարի 1-ից ավելացված արժեքի հարկից ազատվում է նաև հետադարձ հիփոթեքի պայմանագրով բանկի սեփականությունը դարձած բնակարանի օտարումը (Հարկային օրենսգրքի 64-րդ հոդվածի 2-րդ մասի 47-րդ կետի «ժբ» ենթակետ)։

 

Ամփոփելով՝ 2027 թ.-ի հունվարի 1-ից կենսաթոշակային տարիքի հասած սեփականատերը կկարողանա բնակարանը հետադարձ հիփոթեքով գրավ դնել, իսկ դրա դիմաց ստացվող ամենամսյա վճարումները եկամտային հարկով չեն հարկվի», – տեղեկացնում է կայքը։
