Ամեն օր հաղորդվում է տարբեր բնագավառներում չարաշահումների, հափշտակությունների, պաշտոնական դիրքի չարաշահումների մասին: Հասարակությանը հիմնականում անհայտ է մնում դրանց իրական կամ հորինված լինելը: Արդյո՞ք նման դեպքերում պետական իրավասու մարմինները քննություն իրականացնում են, եթե, այո´, ապա հրապարակված նյութի հեղինակը դրա համար կրո՞ւմ է պատասխանատվություն, թե՞ ոչ:

Այս հարցերի շուրջ Past.am-ը զրուցեց փաստաբան Տիգրան Սարգսյանի հետ:

- Պարոն Սարգսյան, երբ լրատվամիջոցը նյութ է հրապարակում, որտեղ անձեր են մեղադրվում հանցագործությունների մեջ, ո՞վ և ինչպե՞ս պետք է ստուգի դրանց իրական կամ հորինված լինելը:

-ՀՀ օրենսդրության համաձայն` լրատվամիջոցի հանցագործության մասին հաղորդումը քրեական գործ հարուցելու առիթ է: Իսկ քրեական գործ հարուցելու առիթի առկայության դեպքում պարտադիր պետք է ստուգվեն նաև քրեական գործ հարուցելու հիմքերի առկայությունը, այսինքն` հանցանքի հատկանիշների առկայությունը: Եթե միաժամանակ առկա է քրեական գործ հարուցելու հիմքն ու առիթը, ապա քննիչը կամ դատախազը պարտավոր են քրեական գործ հարուցել: Բնականաբար, քրեական գործ հարուցելուց առաջ պետք է նախնական որոշ հանգամանքներ ճշտվեն։ Օրենսդրության համաձայն` դա կոչվում է նյութերի նախապատրաստություն: Իրավապահ մարմինները պարտավոր են լրատվամիջոցով հրապարակված հանցագործությունների իրական կամ հորինված լինելը ճշտել, ցանկալի կլիներ, որ դրա մասին նաև հասարակությանն իրազեկվեր:

- Եթե լրատվամիջոցի հրապարակումը չի համապատասխանում իրականությանը, կարո՞ղ է հեղինակը պատասխանատվության ենթարկվել:

- ՀՀ քրեական օրենսգիրքը պատասխանատվություն է նախատեսում սուտ մատնության համար, երբ անձը հաստատապես իմանալով, որ հանցանքի վերաբերյալ տեղեկատվությունը կեղծ է, հրապարակում է այն: Այս դեպքում օրենսդիրը նախատեսել է հատուկ պայման, հրապարակողը պետք է հաստատապես իմանա տեղեկատվության կեղծ լինելու մասին և ունենա անձին անհիմն պատասխանատվության ենթարկելու նպատակ: Այս երկու պայմանների առկայությունը կամ բացակայությունը պետք է հաստատի քրեական հետապնդման մարմինը:

- Քրեական պատասխանատվությունից բացի՝ այլ պատասխանատվության կարո՞ղ է ենթարկվել լրատվամիջոցը, եթե անձին մեղադրում է հանցանքի մեջ:

-ՀՀ օրենսդրությունը անձին հնարավորություն է տալիս դատական կարգով պաշտպանել իր պատիվն ու արժանապատվությունը վիրավորանքներից և զրպարտություններից: Այստեղ շատ կարևոր է պարզել լրատվամիջոցի նպատակը՝ տեղեկավտությունը հրապարակվում է անձին արատավորելո՞ւ, թե՞ քաղաքացիներին նախազգուշացնելու, պատկան մարմինների ուշադրությունը խնդրի վրա հրավիրելու համար: Եթե լրատվամիջոցի նպատակը խնդիրը քննարկման առարկա դարձնելն է, այլ ոչ թե անձին զրպարտելը, ապա պատասխանատվության հարց չի առաջանա:
