Փաշինյանի սիրտը վիրահատական միջամտություն է ցանկանում

Նիկոլ Փաշինյանը Սահմանադրություն փոխելու նոր պատճառաբանություն է հորինել՝ մեղադրանքի սլաքներն ուղղելով արդարադատության համակարգի դեմ։ «Քիմիոթերապիան այլևս էֆեկտ չի տալիս, մեզ պետք է վիրահատական ճանապարհներով լուծել այդ թվում՝ արդարադատության հարցը»,- ասել է նա՝ իրավիճակը արդարադատության ոլորտում գնահատելով խայտառակ։
«Շատ ոլորտներում մենք մաֆիայի դեմ ենք պայքարում, և էդ մաֆիան իրա մետաստազները ունի բոլոր տեղերում․ էդ մաֆիան իր մետաստազները ունի Ազգային ժողովում, Կառավարությունում, դատարաններում, Դատախազությունում, քննչական մարմիններում, Ոստիկանությունում։ Հերիք ա, հերիք ա, էդ բանի, ժողովրդի ներվերը ինչքա՞ն կարելի ա քայքայել,- ասել է նա։
Ըստ Փաշինյանի՝ օրգանական պրոբլեմ կա, արդարադատության համակարգը ժողովրդի հետ կապ չունի, Հայաստանի Հանրապետությունում չի կարող լինել իշխանության մարմին, որը չի բխում ժողովրդից։ Թե ինչու ութ տարի լինելով իշխանության՝ չեն արել այդ փոփոխությունները, Փաշինյանը մեղքը գցում է գործող Սահմանադրության վրա։ Նա նաև նոր դավադրություն է մոգոնել․ երդվյալ ատենակալների ինստիտուտ է ուզում ներդնել։ Ի դեպ, այդ մասին առաջին անգամ Փաշինյանը խոսել էր ուղիղ մեկ տարի առաջ՝ կրկին կառավարության ծրագրի կատարողականը ներկայացնելիս։ Երդվյալ ատենականների ինստիտուտի ներդրումը կարող է արդյունավետ լինել միայն ձևավորված ժողովրդավարական ավանդույթներով երկրում, այն էլ՝ ոչ փոքր երկրներում։ Հայաստանում, որտեղ բոլորը բոլորին ճանաչում են, իրար հետ կապված են և կարող են ընդհանուր շահեր, ծանոթներ, բարեկամներ ունենալ, երդվյալ ատենականների ինստիտուտը պարզապես քաղաքական ներգործության ու ճնշման գործիք է դառնալու։
Առավել ևս, որ փաշինյանական իշխանությունը կարող է այնպիսի համակարգ մտցնել, որ երդվյալ ատենակալներ դառնան գործող իշխանությանը լոյալ կամ հավատարիմ անձինք, որոնք էլ պրոֆեսիոնալ դատավորների փոխարեն վճռեն տարբեր գործերի ճակատագրերը։ Իսկ այս պարագայում սա արդարադատության համակարգի հերթական խեղաթյուրումը կդառնա։ Իհարկե, գործող իշխանությունները հրաշալի հասկանում են իրենց դավադրության ողջ հետևանքները, բայց և փորձում են ամբողջությամբ իրենց ձեռքը վերցնել արդարադատության համակարգի կառավարումը՝ գործնականում բացառելով ըմբոստության և իշխանության դեմ դիմադրության որևէ դրսևորում։
