Թե՛ ներքին, թե՛ արտաքին կարծիքները շարունակում են մնալ անտեսված
POLITICSԵրեկ «Իմ քայլը» խմբակցությունը առանց ընդդիմության մասնակցության, առանց հանրության կարծիքը հաշվի առնելու հապճեպ ո րեն հրավիրեց արտահերթ նիստ՝ լուծելու ՍԴ- ն ևս փաշինյանական դարձնելու ծրագիրը:
Ըստ այդ «գաղափարի», դադարեցվում է ՍԴ երեք դատավորների պաշտոնավարումը, իսկ ՍԴ նախագահ Հրայր Թովմասյանը կշարունակի պաշտոնավարել միայն որպես ՍԴ դատավոր:
Այս նախաձեռնությունն ընդդիմադիր գրեթե բոլոր ուժերն ու իրավաբանական հանրության մեծ մասը որակել են որպես հակասահմանադրական: Խոսքը թե՛ բովանդակության, թե՛ ընթացակարգի մասին է, քանզի եզրակացության համար ՍԴ չեն դիմել, ինչը հստակ ամրագրված է Սահմանադրությամբ, իսկ ՀՀ նախագահի ստորագրման ընթացակարգը «քայլողները» վերացնում են «ոտքի վրա»:
Արդյունքում որոշ ուժեր և մասնագետներ այս գործընթացն արդեն գնահատել են որպես «իշխանության զավթում», «սահմանադրական կարգի տապալում», «սահմանադրական հեղաշրջում»:
«Փաստ» թերթի հետ զրույցում «Իրավական ուղի» հասարակական կազմակերպության համահիմնադիր Ռուբեն Մելիքյանը նշել է, որ «այսպիսով խախտվում է դատավորների անփոփոխելիության սկզբունքը, խախտվում է նաև ժողովրդավարության ամենակարևոր՝ իշխանությունների բաժանման և հավասարակշռման սկզբունքը»:
Ըստ Մելիքյանի, «իշխող քաղաքական ուժը օր օրի վերածվում է դասական բռնատիրական մի վարչակարգի»:
Ի դեպ, երեկ Վենետիկի հանձնաժողովը ափսոսանք էր հայտնել, որ «Հայաստանի խորհրդարանում սահմանադրական փոփոխությունների նախագիծը ներկայացվում է Վենետիկի հանձնաժողովի կարծիքի հրապարակման օրը, և ՀՀ ԱԺ նախագիծը չի համապատասխանում հանձնաժողովի կարծիքում եղած առաջարկներին»:
Միևնույն ժամանակ, Եվրոպայի խորհրդի գլխավոր քարտուղար Մարիա Պեյչինովիչ Բուրիչը ՀՀ իշխանություններին կոչ էր արել «առաջնորդվել Վենետիկի հանձնաժողովի կարգադրություններով՝ սահմանադրական ճգնաժամը 2015 թվականի Սահմանադրության համապատասխան դրույթների սահուն կատարմամբ և Եվրոպայի խորհրդի չափանիշների համապատասխան հաղթահարելու համար»:
Սակայն փաստացի թե՛ ներքին, թե՛ արտաքին կարծիքները իշխանությունների կողմից շարունակում են մնալ անտեսված:
