Հայաստանի երրորդ նախագահ Սերժ Սարգսյանի շուրջ ստեղծված իրավիճակը կոնկրետ վկայում է, թե ինչպես է գործող իշխանություններն աղավաղում և վարկաբեկում Հայաստանի դատական համակարգը։ Երևանի ընդհանուր իրավասության դատարանում երեկ դիզվառելիքի գործով դատական նիստին, մեղադրողը միջնորդել է երրորդ նախագահին մեղավոր ճանաչել առաջադրված մեղադրանքում, սակայն ազատել քրեական պատասխանատվությունից վաղեմության ժամկետներն անցնելու հետևանքով։

Սերժ Սարգսյանը, գործարար Բարսեղ Բեգլարյանն ու ևս մեկ հոգի մեղադրվում էին դիզվառելիքի սուբսիդիայի 489 միլիոն դրամը հափշտակելու մեջ։ Քրեական գործը կարվել էր գյուղատնտեսության նախկին նախարար Սերգո Կարապետյանի ցուցմունքի հիման վրա։ Կարապետյանն ինքն էլ այս գործում մեղադրյալ էր, սակայն մահացել էր կորոնավիրուսից։

Իշխանությունները շարունակեցին այս անհեթեթ գործի քննությունը և հասցրեցին այնտեղ, որ վաղեմության բոլոր ժամկետներն անցել են։ Ըստ էության, նույնիսկ եթե դատարանը Սերժ Սարգսյանին մեղավոր ճանաչի, ապա ստիպված է լինելու պարզապես հանգիստ թողնել նրան։

Սարգսյանն ինքը մշտապես հերքել է բոլոր մեղադրանքները, ընդ որում դատական հաջորդ նիստին, դեկտեմբերի 21-ին նրա պաշտպանները բավականին լուրջ ելույթով են հանդես գալու։ Մեկ այլ կարևոր հանգամանք, դատարանի որոշմամբ նաև չեղարկվել է Սերժ Սարգսյանի խափանման միջոց՝ ստորագրությունը, այսինքն երրորդ նախագահն այլևս կարող է հանգիստ լքել Հայաստանի տարածքը, աշխարհի ցանկացած կետում հանդիպել ցանկացած մարդու հետ։

Բացակայելու արգելքի խափանման միջոցը, գործող իշխանությունները տևական ժամանակ օգտագործել են ընդդիմախոսներին հետապնդելու, ինչպես նաև արտերկրում նրանց հնարավոր հանդիպումները կամ քաղաքական քայլերը խափանելու նպատակով։ Ցանկացած պարագայում Սերժ Սարգսյանի գործը վկայում է Հայաստանի իշխանությունների դիլետանտության և ոչ կոմպետենտության մասին։
