ՍԴ-ն երկարաձգել է Քոչարյանի և մյուսների գործի վարույթը կասեցնելու վերաբերյալ դիմումի ուսումնասիրման ժամկետը

Սահմանադրական դատարանը երկարաձգել է ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի և մյուսների գործի վարույթը կասեցնելու և ՍԴ դիմելու մասին Երևան քաղաքի ընդհանուր իրավասության դատարանի դատավոր Դավիթ Գրիգորյանի դիմումի նախնական ուսումնասիրման ժամկետը։
Սահմանադրական դատարանի դատավոր Հրայր Թովմասյանը, ղեկավարվելով Սահմանադրական դատարանի աշխատակարգի 29-րդ կետով որոշել է ուսումնասիրություններ կատարելու նպատակով 2019 թվականի մայիսի 20-ին Սահմանադրական դատարան մուտքագրված Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի դիմումի նախնական ուսումնասիրման ժամկետը երկարաձգել մինչև 2019 թվականի հուլիսի 9-ը:
Սահմանադրական դատարանում Ռոբերտ Քոչարյանի ներկայացուցիչ Արամ Վարդևանյանը, Tert.am-ի հետ զրույցում մեկնաբանելով որոշումը, ասաց, որ օրենքով սահմանած կարգով կարող է երկարաձգել մինչև հուլիսի 9-ը, սակայն դա նպատակահարմար ժամկետ չէ:
«Սա քիչ հանդիպող երևույթ է: Կարծում եմ, որ կարող էին ավելի սեղմ ժամկետ սահմանել»,- ասաց Արամ Վարդևանյանը:
Հիշեցնենք, որ դատավոր Դավիթ Գրիգորյանը մայիսի 20-ին որոշում էր կայացրել Ռոբերտ Քոչարյանի և մյուսների վերաբերյալ գործի վարույթը կասեցնել և Քոչարյանին և մյուսներին առաջադրված ՀՀ ՔՕ 300.1 հոդվածի՝ (սահմանադրական կարգը տապալելը) սահմանադրականության հարցը պարզելու հիմքով դիմել ՍԴ։ Բացի այդ, դատարանն արձանագրել էր, որ Քոչարյանն օգտվում է պաշտոնաթող նախագահի համար ՀՀ Սահմանադրությամբ նախատեսված գործառութային անձեռնամխելության երաշխիքից:
