Արտակարգ դրության երկարաձգումը մի նպատակ ունի՝ հետաձգել հանրաքվեի հարցը․ Ռուբեն Մելիքյան

Իրավապաշտպան Ռուբեն Մելիքյանն իր ֆեյսբուքյան էջում գրել է․

«Կառավարության կայքում արդեն իսկ տեղադրված է արտակարգ դրությունը ևս 30 օրով երկարացնելու որոշման նախագիծը։ 

Վերահաստատում եմ մոտեցումս՝ ներկա օրենսդրական ձևակերպումների պայմաններում ռեժիմը երկարացնելու հակաիրավականության մասին։ Հիշեցնեմ, որ օրեր առաջ տեսակետ էի հայտնել, որ իսկապես անհրաժեշտ սահմանափակումների մեխանիզմները կարող են ներառվել «սովորական» օրենքներում և ավարտել արտակարգ դրությունը։

Կառավարությունը գնում է այլ ճանապարհով, և վերջին օրերի իրադարձությունները վկայում են, որ նպատակը ամենևին բարի չէ՝ երկարացնել ոչ անհրաժեշտ սահմանափակումները, հետաձգել հանրաքվեի հարցը՝ մինչև մի բան «մոգոնեն»։

Ոչ անհրաժեշտ, բայց քայլականների համար շատ «հաճելի» սահմանափակումներից առաջինը հավաքների հիմնարար ազատությունից բոլորիս զրկելն է՝ արդեն անհամաչափ երկար ժամանակ։ Արտակարդ դրութան ռեժիմի այդ միջոցառումը, թեև հակաիրավական՝ բայց կարող էր դիտվել «հանդուրժելի», եթե քաղաքական իշխանությունն առիթը չօգտագործեր ու (ա) օրակարգ չբերեր ու չընդուներ խիստ վիճելի, պատշաճ չքննարկված օրենքներ ու կոնվենցիաներ, (բ) չսկսեր խիստ վիճելի ու ակնհայտ քաղաքական երանգ ունեցող քրեական գործեր ու քրեական հետապնդումներ։

Ներկա վիճակում ակնկալում եմ, որ խորհրդարանական ընդդիմությունը այսօր գումարվելիք ԱԺ հատուկ նիստում կբարձրացնի հավաքների ազատության նկատմամբ տոտալ արգելքը վերացնելու հարցը։ Թեկուզ ծեծվելու գնով։

ՀԳ. Առհասարակ կարծում եմ՝ համաճարակով պայմանավորված արտակարգ դրության վիճակում, համաճարակի տարածումը զսպող և դրա հետևանքները մեղմող օրենքներից զատ, ցանկացած այլ օրենքի ընդունում ո՛չ լեգիտիմ է, ո՛չ ժողովրդավարական, ո՛չ էլ իրավաչափ։ Հուսով եմ՝ իշխող ուժի այդպիսի «դաղալություններին» ժամանակին կտրվի համարժեք իրավական գնահատական»։
